13. The term "laborer" means any mechanic, skilled or unskilled laborer or day workman, employed or seeking employment in a position in the labor class.

Rule II.

General Provisions

1. The violation of any of the provisions of the Civil Service Law or of these rules by any person in the Civil Service of the city shall be considered a good cause for the dismissal of such person from the service.

2. No person in the Civil Service of the city shall use his official authority or influence to coerce the political action of any person or body; or shall dismiss or cause to be dismissed, or make any attempt to procure the dismissal of, or in any manner change the official rank or compensation of, any person in such service, because of his political opinions or affiliations.

3. No question in any examination, or form of application or other proceedings by or under the Commission or their examiners shall be so framed as to elicit information concerning, nor any other attempt be made to ascertain the political opinions or affiliations of any applicant, competitor or eligible, and all disclosures thereof shall be discountenanced by the Commission and its examiners, and no discrimination shall be exercised, threatened or promised against or in favor of any applicant, competitor or eligible, because of his political opinions or affiliations.

4. No recommendation of an applicant, competitor or eligible involving any disclosure of his political opinions or affiliations shall be received, filed or considered by the Commission, by an examining board, or by any nominating or appointing officer.

5. No appointment or selection to or removal from an office or employment within the scope of any rules established under the Civil Service Law shall be in any manner affected or influenced by any political opinions or affiliations.

6. No person in the Civil Service of the city shall be obliged to contribute to any political fund or to render any political service; nor shall any such person, directly or indirectly, use his authority or official influence to compel or induce any other person in such service to pay or promise to pay any political assessment, subscription or contribution.

7. In making removals or reductions, or in imposing penalties for delinquency or misconduct, in the city service penalties like in character shall be imposed for like offenses and action thereon shall be taken irrespective of the political opinions or affiliations of the offenders.

Rule III. Appointment of Commissioners

There shall be a Municipal Civil Service Commission, which shall be composed of three citizens of the city of Jamestown, designated and appointed by the Mayor, each of whom shall be known as a Municipal Civil Service Commissioner of the city of Jamestown, and not more than two of whom shall belong to the same political party.

The Commission shall select from its number a president, a vice-president and a secretary. The secretary nominated from the Commission shall keep

the minutes of its proceedings in due form. He will keep the necessary records of applicants, their examinations and standing; record of all persons employed in the several departments and offices to which these rules apply, and shall record all appointments, promotions, transfers, dismissals, resignations and changes of any sort therein, and perform such other duties as the Commission shall assign him. He shall also see that the rules and regulations are complied with and bring any case of their infraction to the attention of the Commission.

The Commission may employ an examiner whenever in its judgment the examinations are of such technical nature as to require the assistance of an expert. All questions and tests, however, to be used in any examination shall first be approved by the Commission, and the examination papers shall be marked under the direct supervision of the Commission. The commissioners shall each receive such compensation as may be fixed by the Common Council. All necessary expenses of the Commission, including clerical work, expert services, typewriting, stenography, printing, postage, telephone and telegraph services and stationery supplies shall be paid for by the city when properly audited by the Commission.

The Civil Service of the city of Jamestown is divided into the unclassified service and the classified service.

1. The unclassified service includes:

First-All officers elected by the people, viz:

Mayor

Aldermen

City clerk

Police justice

Justices of the peace

Overseer of the poor

Assessors

Constables

Supervisors

Members of the board of education

Second All election officers

Third — The head or heads of any department of the city government, viz:

Corporation counsel

City treasurer

City auditor

City engineer

Superintendent of streets

Superintendent of public works

One assessor

Chief of the fire department

Chief of the police department

Commissioners of water and light

Park commissioners

Members of the board of health

Civil Service Commissioners

City hospital commissioners

Fourth-All persons employed in or who seek to enter the public service as superintendents, principals or teachers in the public schools of the city, viz:

The superintendent, principals and teachers employed by the board of education.

2. The classified service includes all positions not in the unclassified service. The positions in the classified service are hereby classified into four classes, to be known as the Exempt Class, the Competitive Class, the NonCompetitive Class and the Labor Class.

Rule V. The Exempt Class

The Exempt Class shall include:

First — The deputies of principal officers authorized by law to act generally for and in place of their principals.

Second One secretary for each officer, board or commission authorized by law to appoint a secretary.

One clerk, and one deputy, if authorized by law, of each court, and one clerk of each elective judicial officer.

Fourth Such other subordinate offices for the filling of which competitive or non-competitive examinations may be found not practicable, but no office or position shall be deemed to be in the Exempt Class unless it is specially named in the schedule of Exempt Class hereto annexed.

The appointments to positions comprised in the Exempt Class may be made without examination under these rules. Appointing officers must notify the Commission in writing of all appointments to such positions within twenty-four hours after the same are made, setting forth the full name of such appointee, the date and place of birth, length of residence in the city of Jamestown, nature of previous employment, whether he has ever been in official service before, and if so, when and where; date of beginning of service and term for which appointed, salary, and the name of the person in whose place appointed; all of which shall be duly certified by the appointing officer.

Rule VI. Competitive Class

The Competitive Class shall include all positions in the classified service, now existing or hereafter created or established, for which it would be practicable to determine the merit and fitness of candidates by competitive examination, and to which positions appointments shall be made of those graded highest in open competitive examinations, as provided in these rules, and is made up as follows:
