defendant. If, in the case of a collision, it happen from the improper or unskilful navigation of the other vessel, or any other cause, rendering it, as to the defendant, an unavoidable occurrence, he is entitled to the verdict of acquittal. In a civil action to recover damages on ac

count of the death of libellant's intestate, alleged to have been caused by the negligence of the defendant while transporting the deceased on its steam-ferry, vindictive or exemplary damages, by way of punishment, cannot be recovered, as this statute has otherwise provided for that. Holmes v. Oregon,, etc., R. Co., (1881) 5 Fed. Rep. 523.

An act relating to the punishment of the crime of manslaughter.

[SEC. 1.] [Manslaughter; how punished.] That whoever shall hereafter be convicted of the crime of manslaughter, in any court of the United States, in any State or Territory, including the District of Columbia, shall be imprisoned not exceeding ten years, and fined not exceeding one thousand dollars: Provided, That this act shall not affect or apply to any prosecution now pending, or the prosecution of any offence already committed. [18 Stat. L. 473.]

SEC. 2. [Repeal.] That all acts or parts of acts inconsistent with this act are hereby repealed: Provided, That said acts shall remain in force for the punishment of all persons who have heretofore committed the crime of manslaughter. [18 Stat. L. 473.]
