Resolved, That, subject to the approval of the Governor, civil service rule XXIV, fourth paragraph, be amended by striking out the word "Canandaigua," so that the same shall read as follows:

"In pursuance of the foregoing provision these rules have been further extended to the offices, places and employments, in the civil service of the villages of Batavia, Ossining, Peekskill, Port Chester, Saratoga Springs and White Plains, to take effect from and after March 31, 1910."

Rule XXIV

Resolved, That, subject to the approval of the Governor, civil service rule XXIV be and hereby is amended by adding thereto the following:

"In pursuance of the foregoing provision these rules have been extended to the offices, places and employments in the police departments of the villages and towns of Westchester County, to take effect May 17, 1913."

Rule XXIV

CATION

Department of Labor

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Department of Labor, be amended by striking out the words: "one mercantile inspector," competitive examination for said position being deemed. practicable.

County Clerk, Kings County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the County Clerk, Kings County, be amended by striking out the words "one deputy as general clerk of the Supreme Court." (Adopted January 10, 1913. Approved by the Governor, January 27, 1913.)

Supreme Court, Kings County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Supreme Court, Kings County, be amended by adding thereto the words

one general clerk," it appearing that but one position is involved, and that it should be listed under the Supreme Court rather than included in the classification of positions in the office of the County Clerk.

Supreme Court, Appellate Division, Third Department

Resolved, That, subject to the approval of the Governor, classification of positions in the exempt class in the Supreme Court, Appellate Division, Third Department, be amended by adding thereto the words "one consultation attendant," competitive or non-competitive examination for said position having been found to be not practicable.

Iola Sanatorium, Monroe County

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class at the Iola Sanatorium, Monroe County, be amended by adding thereto the words "carpenter, salary not to exceed $45 per month; watchman, salary not to exceed $40 per month; orderly, salary not to exceed $45 per month," competitive examination for said positions being found to be not practicable.

Tax Commission

Communication from Chairman Byrnes, State Board of Tax Commissioners, under date of January 13th, applying for classification in the exempt class of the position of mortgage tax examiner, salary $2,500 per annum, was submitted. For the reasons stated in the communication of Chairman Byrnes, the following resolution was adopted:

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Board of Tax Commissioners be and hereby is amended by adding thereto the words "one confidential mortgage tax examiner," competitive or non-competitive examination for said position being found to be not practicable.

Executive Departmtnt

Communication from Governor Sulzer under date of January 17th, requesting classification in the exempt class of one position of executive auditor, was read. It appearing that the auditor will be required to perform special duties relating to financial matters and such other duties as the Governor in his discretion may assign, all of which will be of a highly confidential character, it was,

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Governor be amended by adding thereto the words, "executive

auditor," competitive or non-competitive examination for said position being found to be not practicable.

Athletic Commission

Commissioner Wolff, to whom had been referred the application of the State Athletic Commission under date of January 13th, requesting reconsideration of its petition for classification in the exempt class of the position of confidential stenographer, reported and recommended the following resolution, which was on motion adopted:

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the State Athletic Commission be amended by adding thereto the words: "confidential stenographer," competitive or non-competitive examination for said position being found to be not practicable.

Department of Excise

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Department of Excise be amended by adding thereto the words, "first assistant cashier in the office of the Special Deputy Commissioner at New York," competitive or non-competitive examination being found to be not practicable.

Comptroller

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class, in the office of the Comptroller, be amended by striking out the words, "fifteen examiners of transfers of stock," and substituting in lieu thereof the words, "seventeen examiners of transfers of stock," competi

tive or non-competitive examination for said position having been found to be not practicable.

School of Agriculture, Morrisville

Resolved, That, subject to the approval of the Governor, classification of positions in the non-competitive class in the New York State School of Agriculture at Morrisville, N. Y., be amended by striking out the words, "one teacher of agronomy, one teacher of horticulture, one teacher of dairying, one teacher of domestic science, one teacher of academic subjects," the Attorney-General having given an opinion that the teachers at said institution are in the unclassified service.
