Secretary of State

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Secretary of State, be and hereby is amended by adding thereto the words "Secretary, Bureau of State Enumeration," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said position. Comptroller

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Comptroller, be and hereby is amended by adding thereto the words "Chief clerk, stock transfer tax bureau," for the reason that competitive or non-competitive examination is hereby found to be not practicable for filling said position.

State Hospitals

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the state hospitals, be and hereby is amended by adding thereto the words "ruler in printing office," for the reason that competitive examination is hereby found to be impracticable for filling said position.

Forest, Fish and Game Commission

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the office of the Forest, Fish and Game Commission, be and hereby is amended by striking out the words "five assistant fire

wardens," and inserting in lieu thereof the words "five inspectors," for the purpose of changing the title of persons heretofore designated as assistant fire wardens, without increasing the number of positions classified, and to comply with the provisions of chapter 285, Laws of 1905.

Hospital for Incipient Tuberculosis

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the New York State Hospital for Incipient Tuberculosis at Ray Brook, be and hereby is amended by striking out the words "nurses at compensation not exceeding $30 per month and maintenance for women, and $35 per month and maintenance for men," and inserting in lieu thereof the words "Nurses at compensation not exceeding $35 per month and maintenance."

County Clerk, Kings County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the County Clerk of Kings county, be and hereby is amended by adding thereto the following:

Cashier;

Chief clerk of the law department;

Chief clerk of certificates, satisfaction and mechanics' liens; for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said positions.

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Surrogates of New York county, be and hereby is amended by striking out the words "one assistant transfer tax clerk" and inserting in lieu thereof the words "two assistant transfer tax clerks," for the reason that competitive or non-competitive ex

amination has heretofore been found not practicable for filling said position.

Soldiers and Sailors' Home

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Soldiers and Sailors' Home at Bath, be and hereby is amended by adding thereto the words "one cashier," for the reason that competitive or non-competitive examination is hereby found to be not practicable for filling said position.

Resolved, That, subject to the approval of the Governor, the classification of positions in the civil service of the counties of New York, Kings, Queens and Erie, be and hereby is amended by adding to the exempt class the following named positions, for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling the same:

In the office of the Register, New York county: One special deputy register; one cashier, mortgage tax bureau.

In the office of the Register, Kings county: One mortgage tax deputy; one cashier, mortgage tax bureau.

In the office of the County Clerk, Queens county: One mortgage tax deputy; one cashier, mortgage tax bureau.

In the office of the County Clerk, Erie county: One mortgage tax deputy; one cashier, mortgage tax bureau.

Supreme Court, Appellate Division

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Supreme Court, Appellate Division, Second Department, be and hereby is amended by striking out the words "one confidential attendant" and inserting in lieu thereof the words "two confidential attendants," for the reason that competitive or non-competitive

examination has heretofore been found to be impracticable for filling said position.

State Superintendent of Elections

Whereas, It appears that the State Superintendent of Elections is authorized by law to appoint a secretary, Therefore, be it

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the State Superintendent of Elections, be and hereby is amended by adding thereto the words "one secretary," in accordance with section 12, paragraph 2, of the civil service law.

Craig Colony

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class, as enumerated in civil service rule V, be and hereby is amended by inserting therein the following: "In the Craig Colony at Sonyea: One agent who shall also be the treasurer," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said position.

County Clerk, New York County

Resolved, That, subject to the approval of the Governor, the classification of positions in the civil service of New York county be and hereby is amended, for the reasons stated in the communication of Hon. Morgan J. O'Brien, Presiding Justice, Supreme Court, Appellate Division, First Department, under date of June 12, 1905, as follows: By striking from the exempt class in the office of the County Clerk of New York county the following: "Twenty-one deputies and special deputies, appointed to attend upon terms of the courts, to wit: One for the Appellate Term of the Supreme Court, one for the Trial Term, Part I (who shall be also the clerk of the Court of General Sessions), one each for the eleven Trial Terms, and one each for the eight Special Terms," and by inserting in lieu thereof the following:

"Twenty-two deputies and special deputies, appointed to attend upon terms of the courts, to wit: One for the Appellate Term of the Supreme Court, one for the Trial Term, Part I (who shall be also clerk of the Court of General Sessions), one each for the twelve Trial Terms, and one each for the eight Special Terms." (Adopted June 22, 1905. Approved by the Governor June 29, 1905.)

Surrogates, New York County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Surrogates, New York county, be amended by striking out the words "two assistant transfer tax clerks" and substituting in lieu thereof the words "one assistant transfer tax clerk, one stenographer to the transfer tax assistant," in view of the fact that chapter 368, laws of 1905, provides for the appointment of a stenographer instead of an assistant transfer tax clerk, whose duties are substantially the same as those heretofore performed by one of the assistant transfer tax clerks, which positions were classified in the exempt class for the reason that competitive or non-competitive examination had been found to be impracticable for filling the same.

Comptroller

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Comptroller be and hereby is amended by adding thereto the words "five examiners of transfers of stock," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said position.
