Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the State service be and hereby is amended by adding thereto the following:

In the office of the Commission of Gas and Electricity: Secretary; secretary in charge of New York city office; one chief clerk of records.

Craig Colony and Hospital for Incipient Tuberculosis

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the Craig Colony at Sonyea and in the New York State Hospital for Incipient Tuberculosis at Ray Brook, be and hereby is amended by adding thereto the words "medical interne," for the reason that competitive examination is hereby found to be impracticable for filling said positions.

Commissioner of Agriculture

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Commissioner of Agriculture, be and hereby is amended by adding thereto the words "one confidential agent," for the reason that competitive or non-competitive examination is hereby found to be not practicable for filling said position.

Department of Public Buildings

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class in the Department of Public Buildings, be and hereby is amended by striking from the following paragraph the figures "1905" and inserting in lieu thereof the figures "1906":

"Two assistant engineers and four firemen, such persons, however, to be subject to non-competitive examination and their em

ployment not to continue beyond thirty days after the adjournment of the Legislature of the year 1905."

Commission of Gas and Electricity

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Commission of Gas and Electricity, be and hereby is amended by adding thereto the words: "One gas expert, one electrical expert," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said positions.

Supreme Court Reporter

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the State service, be and hereby is amended by inserting therein the following: "In the office of the Supreme Court reporter: The supreme court reporter, one deputy, one secretary," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said positions.

State Water Supply Commission

Whereas, The State Water Supply Commission is authorized by chapter 723 of the laws of 1905 to appoint a secretary, which position shall be included in the exempt class in accordance with the provisions of section 12, paragraph 2, of the civil service law, and

Whereas, This commission hereby finds that it is impracticable to fill by competitive or non-competitive examination the position of consulting engineer to the State Water Supply Commission; Therefore, be it

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the State service, be and hereby is amended by inserting therein the following:

"In the office of the State Water Supply Commission: The secretary, one consulting engineer."

Probation Commission

Whereas, The Probation Commission, created by chapter 714 of the laws of 1905, is authorized by said law to appoint a secretary; Therefore, be it

Resolved, That in accordance with section 12, paragraph 2, of the civil service law, and subject to the approval of the Governor, the classification of positions in the exempt class in the State service, be and hereby is amended by inserting therein the following:

"In the office of the Probation Commission: The secretary.” (Adopted October 20, 1905. Approved by the Governor October 25, 1905.)

Department of Excise

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Department of Excise, be and hereby is amended by inserting therein the following words: "One confidential messenger in the office of the special deputy commissioner for the Boroughs of Manhattan and the Bronx," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said position.

Albany County Almshouse

Resolved, That, subject to the approval of the Governor, the classification of positions in the civil service of the county of Albany, be and hereby is amended by adding to the exempt class in the Almshouse the words "two chaplains," for the reason that competitive or non-competitive examination has heretofore been found impracticable for filling the position of chaplain.

Supreme Court, Appellate Division

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Supreme Court, Appellate Division, Fourth Department, be and hereby is amended by adding thereto the words "one assistant clerk," for the reason that competitive or non-competitive examination is hereby found to be impracticable for filling said position.

Register, Westchester County

Resolved, That, subject to the approval of the Governor, the classification of positions in the civil service of the county of Westchester be and hereby is amended by adding to the exempt class, in the office of the Register, the words "one mortgage tax deputy; one cashier, mortgage tax bureau," for the reason that competitive or non-competitive examination has heretofore been found impracticable for filling said positions.

Surrogate, Kings County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Surrogate of Kings county, be and hereby is amended by striking therefrom the words "one assistant clerk" and inserting in lieu thereof the words "one probate clerk," and by striking out the words "one custodian" and inserting in lieu thereof the words "one chief custodian," for the purpose of changing the titles of positions to make them appropriate to the duties performed by the incumbents thereof.

Charitable Institutions

Resolved, That, subject to the approval of the Governor, the classification of positions in the non-competitive class, as enumerated in civil service rule XVIII, be and hereby is amended as follows:

By striking from the list of positions in the Soldiers and Sailors' Home at Bath, the words "Nurses at compensation not exceeding $25 per month and maintenance for women and $35 per month and maintenance for men;"

By striking from the list of positions in the New York State Hospital for Incipient Tuberculosis at Ray Brook, the words "Nurses at compensation not exceeding $35 per month and maintenance;"

By striking the words "Nurses at compensation not exceeding $25 per month and maintenance," from the list of positions in the following institutions:

In the State Industrial School at Rochester;

In the New York State Training Schools for Girls at Hudson; In the House of Refuge for Women at Albion;

In the Reformatory for Women at Bedford;

In the Institution for Feeble-Minded Children at Syracuse; In the Custodial Asylum at Newark;

In the Craig Colony at Sonyea;

In the Thomas Indian School at Iroquois;

In the Women's Relief Corps Home at Oxford;

In the New York State Hospital for the Care of Crippled and Deformed Children.

Resolved, That, subject to the approval of the Governor, the foregoing resolution amending the classification by transferring from the non-competitive class to the competitive class the posi tion of nurse in the state charitable institutions, take effect from and after October 1, 1905.
