at salaries not exceeding $480. Promotion from the position of junior clerk to that of clerk will be allowed under the rules governing promotion when the appointee shall have attained the age of twenty-one years.

Eligible List Canceled

The chief examiner presented correspondence from Commissioner of Health Porter, Director Gaylord of the cancer laboratory, and Miss Marie Onuf, in relation to the recent examination for the position of assistant in microscopy, cancer laboratory, Department of Health. On motion it was

Resolved, That the recently established eligible list for the position of assistant in microscopy be and hereby is canceled, on the ground that the examination was not a proper one for the position to be filled, and that persons who entered the former examination be allowed to enter a new examination for the same position.

No Authority to Sub-divide Judicial Districts for Appointments A communication from Supreme Court Justice Wilmot M. Smith, dated December 5, 1905, relative to special examination for the position of court stenographer, second judicial district, for appointment outside of Kings county, was read. On motion the secretary was directed to advise Justice Smith that the Commission has no power to grant his request for the reason that the civil service law does not recognize the sub-division of judicial districts.

Examination for Clerk, Supreme Court, Kings County President Milliken presented a communication, with enclosure, addressed to him under date of December 7, 1905, by D. U. Quick, Brooklyn, N. Y., in relation to the rating accorded him for "fitness and record in the department" in the last examination for promotion to the position of court clerk, Kings county, which rating was based upon a communication from James F. McGee, general clerk of the Supreme Court, Kings county, under date of March 17, 1905. On motion the following resolution was adopted:

Resolved, That the secretary be directed to address a communication to the justices of the Supreme Court residing in Kings county, transmitting a copy of the papers submitted by Mr. Quick, and say that it is the opinion of the Commission that if the conclusion given as to Mr. Quick's fitness for promotion is based on any action by Mr. Quick to bring to the attention of this Commission violations of law, or to assert his rights under the law, any adverse judgment upon him for these reasons is insufficient to bar him from promotion, and that this Commission feels, in view of Mr. Quick's complaint of injustice, that it should have a detailed statement of the basis for the judgment expressed in the communication of the general clerk of the court under date of March 17, 1905.
