DESIGNATION OF JUSTICE JAMES W. HOUGHTON

TO THE APPELLATE DIVISION, FIRST DE-
PARTMENT

STATE OF NEW YORK

EXECUTIVE CHAMBER

It appearing to my satisfaction that the public interest requires it;

THEREFORE, In accordance with section two of article six of the Constitution, the

HONORABLE JAMES W. HOUGHTON

of the village of Saratoga Springs, who is a Justice of the Supreme Court of the Fourth Judicial District, is hereby designated as Associate Justice of the Appellate Division of the Supreme Court in and for the First Judicial Department, for the term ending October twenty-fifth, 1910, in the place of Edward W. Hatch, resigned.

GIVEN under my hand and the Privy Seal of the State at the Capitol in the city of Albany this twentyfifth day of October in the year of our Lord one thousand nine hundred and five.

PROCLAMATION

CALLING ATTENTION ΤΟ

THE PROHIBITION OF POLITICAL ASSESS-
MENTS

October 25, 1905.

TO ALL PUBLIC OFFICERS AND EMPLOYEES:

Your attention is called to section 24 of the Civil Service Law, which reads as follows:

"POLITICAL ASSESSMENTS PROHIBITED.

No officer, agent, clerk, or employee under the government of the state of New York or any civil division or city thereof shall, directly or indirectly, use his authority or official influence to compel or induce any other officer, clerk, agent or employee under said government, or any civil division or city thereof, to pay or promise to pay any political assessment, subscription or contribution. Every said officer, agent, clerk or employee who may have charge or control in any building, office or room occupied for any purpose of said government, or any said division or city thereof, is hereby authorized to prohibit the entry of any person, and he shall not knowingly permit any person to enter the same for the purpose of therein making, collecting, receiving or giving notice of any political assessment, subscription or contribution; and no person shall enter or remain in any said office, building or room, or send or direct any letter or other writing thereto, for the purpose of giving notice of, demanding or collecting a political assessment, nor shall any person therein give notice of, demand, collect or receive any such assessment, subscription or contribution; and no person shall prepare or make out, or take any

part in preparing or making out, any political assessment, subscription or contribution with the intent that the same shall be sent or presented to or collected of any officer, agent or employee, subject to the provisions of this act, under the government of the state of New York, or that of any civil division or city thereof, and no person shall knowingly send or present any political assessment, subscription or contribution to or request its payment of any said officer, agent or employee. Any person who shall be guilty of violating any provision of this section shall be deemed guilty of a misdemeanor."

AS ASSOCIATE JUSTICE OF THE APPELLATE
DIVISION FOR THE THIRD DEPARTMENT

STATE OF NEW YORK

EXECUTIVE CHAMBER

WHEREAS, An order having been made and filed with the Secretary of State upon the written request of the Honorable James W. Houghton, one of the Associate Justices of the Appellate Division of the Supreme Court in and for the Third Judicial Department revoking the designation of the said Houghton as such Associate Justice and a vacancy thus having occurred;

NOW THEREFORE, In accordance with Section 2 of Article 6 of the Constitution the

of the city of Ogdensburg, who is a Justice of the Supreme Court of the Fourth Judicial District is hereby designated as Associate Justice of the Appellate Division of the Supreme Court in and for the Third Judicial Department for the term ending November 13, 1910, such designation as Associate Justice to take effect from and after the thirteenth day of November, 1905.

THANKSGIVING PROCLAMATION

STATE OF NEW YORK

EXECUTIVE CHAMBER

Abundant prosperity has blessed the people of this State in the past year. No rumor of war nor threat of domestic violence has disturbed our peaceful progress. Law and order have prevailed within our borders; labor has been fully employed; all forms of industry have flourished and the future is bright with the promise of material and moral betterment;

NOW THEREFORE, In conformity with our ancient custom, I, Frank W. Higgins, Governor, do hereby designate Thurs

day, the thirtieth day of November, 1905, as a day of general thanksgiving to Almighty God for the great benefits that we have received at his hands.

In the matter of the charges preferred against Frederick D. Kilburn, Superintendent of Banks, by the Organization of Depositors of the German Bank of Buffalo.

DISMISSAL OF CHARGES:

The organization of depositors of the German Bank of Buffalo, has preferred charges against Frederick D. Kilburn, Superintendent of Banks, alleging improper conduct on his part, (1) in relation to the official examinations of said bank by the banking department, and (2) in relation to his failure to close the bank before the morning of the 5th day of December, 1904.
