SEC. 15. Whenever two regiments of volunteer militia shall be organized in the manner hereinbefore provided, the commissioned officers of such regiments shall have power to, and may, elect one brigadier general, who shall be commander of the brig ade thus organized, and who may appoint the same number of staff officers, with the same rank as those of a brigadier general in the army of the United States.

SEC. 16. This act shall take effect and be in force from and after its passage.

MINING RESOURCES.

AN ACT to Provide for the Development of the Mining Resources of the Territory of
Wyoming.

Be it enacted by the Council and House of Representatives of the Ter-
ritory of Wyoming :

SECTION 1. Any person or persons who shall have performed work, or made improvements or expenditures to the amount of one thousand dollars, on any lead, lode or ledge, the same shall not be subject to re-location under the laws of this Territory: Provided, That such quartz claim or claims shall not be abandoned, but Claims to be shall be represented by the person or persons owning such claim or claims, or by his or their agent or attorney, who shall reside within the district in which such claim or claims may be situated, unless driven from said district by Indians.

SEC. 2. Any person or persons who shall defraud, cheat or punished as a swindle any party or parties, by what is known as "salting," that is by placing or causing to be placed in any placer, or quartz claim, or dirt, gravel, or quartz contained therein, any gold, silver or metals, or minerals which would prove to be a misrepresentation, thereby working injury, or loss to any party or parties, shall be deemed guilty of a felony, and, upon conviction thereof, shall be fined in any sum not to exceed five thousand dollars, and not less than fifty dollars, together with the cost of prosecution, and may be imprisoned in the Territorial penitentiary, not more than three years, nor less than thirty days, or both such fine and impris

SEC. 3. When parties owning in partnership any claim or claims, or any lead, lode or ledge, and any one of the parties so owning shall fail to perform his or her portion of the work, for the period of eight months, or pay the reasonable assessment for the same, when said claim is being worked in accordance with the expressed wish of a majority of the persons owning such claim, it may be sold to pay such assessment by the person or persons to whom such assessment may be due, by giving thirty days' notice, published in the nearest newspaper, and by posting notice for thirty days on such claims, giving the amount of assessment due, date of notice and date of sale.

SEC. 4. The provisions of the foregoing section shall not apply to persons residing within the district in which his or her property is situated.

An ACT Defining Certain Misdemeanors and Prescribing Punishment Therefor.

Be it enacted by the Council and House of Representatives of the To ritory of Wyoming:

SECTION 1. An assault is an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another, and every person who shall perpetrate an assault, shall, on conviction, be fined in any sum not exceeding fifty (50) dollars, to which may be added imprisonment in the county jail not exceeding thirty (30) days.

SEC. 2. Every person found guilty of an assault and battery sant and bat shall be punished by a fine not exceeding one hundred (100) doilars, or by imprisonment in the county jail not exceeding six (6) months, or by both such fine and imprisonment.

SEC. 3. Every person, who shall, by words, signs, or gestures, provoke, or attempt to provoke, another to commit an assault, and battery, or other breach of the peace, shall, on conviction, be fined in any sum not exceeding twenty-five (25) dollars.

AN ACT Making it a Misdemeanor to Sell intoxicating Liquors to Indians, and Prescribing Punishment Therefor.

Be it enacted by the Council and House of Representatives of the Torritory of Wyoming :

SECTION 1. That any person or persons who shall sell, barter or intoxicating give away any spirituous or intoxicating liquors to any Indian or liquor to Indi Indians within the limits of this Territory, shall be deemed guilty of a misdemeanor, and, upon conviction thereof, shall be fined in any sum not less than five hundred (500) dollars, nor more than one thousand (1,000) dollars, to which may be added imprisonment in the county jail for any period not less than ninety days nor more than six (6) months, or both, at the discretion of the court. SEC. 2. This act shall take effect and be in force from and after its passage.

MONEY, RETENTION OF.

AN ACT Providing for the Retention in this Territory, of Certain Money Collected therein, under the Laws of Dakota.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming:

SECTION 1.
