BEACON

RULES AND REGULATIONS FOR THE CIVIL SERVICE OF THE CITY OF BEACON.

In compliance with section 11 of the Civil Service Law of the State of New York, the following are prescribed and adopted as the rules for the classification of the offices, places and employments in the classified service of the city of Beacon, N. Y., and for appointments and promotions therein and examinations therefor, and for the registration and selection of laborers for employment therein, and for the due classification of all offices and positions in the City Service included in the Unclassified Service, Classified Service and Labor Class, and the same shall be valid and take effect, and all other rules are revoked, upon the approval of the Mayor of the city of Beacon, N. Y., and of the State Civil Service Commission of the State of New York.

Rule I. Application of Rules.

These rules shall apply to all positions in the Public Service in the city of Beacon, with the exception of those hereinafter enumerated in the unclassified service.

Rule II. Appointment of Commissioners.

For the purpose of ascertaining the merit and fitness of persons seeking or named for positions in the departments and offices of the municipal government to which these rules apply, there shall be a Municipal Civil Service Commission, which shall be composed of three citizens of the city of Beacon designated and appointed by the city council, each of whom shall be known as a Municipal Civil Service Commissioner of the city of Beacon, and not more than two of whom shall belong to the same political party. The city council may, at any time, by filing with the county clerk a written notification of the change, appoint another citizen in the place of any one so designated. It shall be the duty of such

Municipal Civil Service Commission to conduct all examinations called for under these rules, and to certify the same in such manner and form as may be prescribed. They shall also make and file with the State Civil Service Commission such annual and other reports and roster of the classified civil service of said city as required by chapter 15 of the Laws of 1909. The secretary of the board shall keep the minutes of their proceedings and all necessary records of all persons to which these rules apply, and of all appointments, promotions, transfers, dismissals, resignations and changes of any sort therein.

Rule III. Classification of Positions.

The Civil Service of the city of Beacon is divided into the Unclassified Service and the Classified Service.

Rule IV. The Unclassified Service.

The Unclassified Service includes:

First All officers elected by the people.

Second All election officers.

Third- The head or heads of any department or office of the city government.

Fourth Persons employed in or who seek to enter the public service as superintendents, principals and teachers in the educational department of the city.

Rule V. The Classified Service.

The Classified Service includes all positions not in the Unclassified Service. The positions in the Classified Service are hereby classified in four classes, to be known as the Exempt Class, the Competitive Class, the Non-Competitive Class, and the Labor Class, as enumerated in respective schedules hereunto attached and hereby made a part of these rules.

Rule VI. The Exempt Class.

The Exempt Class shall include:

First The deputies of principal executive officers duly authorized by law to act generally for and in place of their principals.

Second One secretary of each officer, board and commission authorized by law to appoint a secretary.

Third-Other subordinate offices for the filling of which competitive or non-competitive examination may be found to be not practicable. But no office or position shall be deemed to be in the Exempt Class unless it is specifically named in such class in schedule of Exempt Class hereunto annexed. Not more than one appointment shall be made to or under the title of any such office or position, unless a different number is specifically mentioned in such schedule.

Fourth In case of an epidemic, riot, flood or other exceeding and necessary emergency, the appointing officers may hire and employ, temporarily, such and so many persons as such emergency renders necessary, forthwith reporting to the Municipal Civil Service Commission the facts in the case and the names of the persons so employed; but no person so employed shall continue in the service for a longer period than ten days, unless, upon the written request of the appointing power setting forth the reasons why an extension of time is necessary, the Municipal Civil Service Commission shall extend the temporary period for an additional ten days.

In case any such extension is authorized the reasons therefor shall be set forth in the minutes of the Municipal Civil Service Commission.

Fifth-There shall also be included in the Exempt Class in the event of an epidemic or other similar emergency in which the public health is seriously endangered, such experts and special inspectors as the board of health may, with the written approval of the Civil Service Commission of the city of Beacon, appoint.

Sixth-The appointments to positions comprised in the Exempt Class may be made without examination under these rules, but such examination may be held upon the request of the nominating or appointing officer. Appointing officers must notify the Municipal Civil Service Commission in writing of all appointments of such positions within five (5) days after the same are made, setting forth the full name of such appointee, length of residence in the city of Beacon, date of beginning of service, and term for which appointed, salary, and the name of the person in
