(Supreme Court, Trial Term, Steuben County. July 23, 1925.) 1. Bridges 38-Statute held to preclude recovery, if bridge collapses because subjected to strain in excess of that permitted. Clear intent of Highway Law, § 331, is to preclude recovery if bridge collapses as result of being subjected to higher strain than that prescribed therein. 2. Bridges ~38—Under Highway Law, town liable for collapse of bridge when only front wheels of truck passed on it and subjected it to strain of less than eight tons. Under Highway Law, § 331, town would be liable for collapse of bridge, if only front wheels of truck passed on it and subjected it to strain of less than eight tons. 3. Bridges 38-Under Highway Law, town not liable for collapse of bridge after truck weighing over eight tons has crossed, and front. wheels have passed from bridge.
