Transfer of John H. Martin, Department of public buildings Resolved, That the transfer of John H. Martin, stenographer, to the position of clerk, department of public buildings, be and hereby is approved, for the reason that it appears that said Martin qualified in an open competitive examination for the position of clerk and that his name appeared upon the eligible list of clerks established October 31, 1899.

Expert, State museum

Resolved, That Harry C. Magnus, employed by the director of the state museum as assistant in the study of the crystalline rocks of Westchester county, be and hereby is excepted from examination under the provisions of civil service rule VIII, section 9, it appearing that Mr. Magnus is a person engaged in private business and that the services rendered are professional, scientific and expert and of temporary and exceptional character; provided, however, that the compensation of Mr. Magnus shall not exceed $60 per month for the months of February and March, 1902.

Smallpox expert, Department of health

Resolved, That Dr. John Thompson, employed by the commissioner of health as special smallpox expert, be, and hereby is, excepted from examination under the provisions of civil service rule VIII, section 9, it appearing that Dr. Thompson is a physi cian engaged in private practice and that the services to be

rendered are professional, scientific and expert and of temporary and exceptional character; provided, however, that the term of employment shall not exceed thirty days at a salary of $125 per month and expenses.

Transfer of Dr. Flavius Packer

A communication from Dr. John Winters Brannan, president, board of trustees of the Bellevue and allied hospitals, New York city, dated January 29, 1902, concerning the transfer of Dr. Flavius Packer, was read. A communication from Superintendent Allison, of the Matteawan state hospital, addressed to Dr. Brannan, consenting to said transfer, was also read. On motion the following resolution was adopted:

Whereas, The trustees of the Bellevue and allied hospitals, New York city, have requested the superintendent of prisons and the superintendent of the Matteawan state hospital to consent to the transfer of Dr. Flavius Packer from the position of first assistant physician at the Matteawan state hospital to a position at the Bellevue hospital; and

Whereas, Superintendents Collins and Allison have consented to said transfer; therefore, be it

Resolved, That the transfer of Dr. Flavius Packer from the position of first assistant physician at the Matteawan state hospital to the superintendency of the pavilion for the insane at Bellevue hospital, New York city, be and hereby is approved, subject to the approval of the municipal civil service commission of the city of New York, Dr. Packer having obtained his present position as the result of a competitive examination conducted by the State Civil Service Commission.

Special agents, Department of public works

A communication from Charles S. Boyd, superintendent of public works, dated January 30, 1902, relative to the transfer of D. D. N. Marvin from the position of collector of statistics to

that of special agent, was considered. On motion the transfer was approved to take effect February 1, 1902, at a salary of $1,000 per annum,

Another communication from Superintendent Boyd, under date of January 30, 1902, requesting authority to transfer W. N. Tubbs from the position of foreman to that of special agent, was read. On motion the secretary was directed to notify Superintendent Boyd that it was the sense of the Commission that it could not comply with his request, for the reason that the requirements for the entrance examinations of these positions are different and it does not appear that Mr. Tubbs has qualified in an open competitive examination for the position of special agent.

Expert, State architect

Resolved, That Olin H. Landreth, employed by the state. architect as consulting expert in sewage disposal matters, be and hereby is excepted from examination under the provisions of civil service rule VIII, section 9, it appearing that Prof. Landreth is a person engaged in private business and that the services to be rendered are professional, scientific and expert and of occasional and exceptional character; provided, however, that his total compensation shall not exceed the sum of $700 for services limited to the house of refuge for women at Hudson and the state custodial asylum at Newark.

Transfer of Dr. Menas S. Gregory

A communication from Dr. John Winters Brannan, president, board of trustees of the Bellevue and allied hospitals, New York city, dated February 12, 1902, requesting the consent of the Commission to the transfer of Dr. Menas S. Gregory, was considered. On motion the following resolution was adopted:

Whereas, The president of the board of trustees of the Bellevue and allied hospitals, New York city, has requested the State Civil Service Commission to consent to the transfer of Dr. Menas

S. Gregory from a position at the Long Island state hospital, Kings Park, to a position at Bellevue hospital, New York city, at a salary of $1,000 per annum; and

Whereas, Superintendent Dewing, of the Long Island state hospital, Kings Park, has consented to said transfer; therefore, be it

Resolved, That the transfer of Dr. Menas S. Gregory from the position of assistant physician at the Long Island state hospital, Kings Park, to the position of assistant resident physician of the pavilion for insane at Bellevue hospital, New York city, be and hereby is approved, subject to the approval of the municipal civil service commission of the city of New York, it appearing that Dr. Gregory obtained his present position as the result of a competitive examination conducted by the State Civil Service Commission.

Transfer of Edward Kenny

A communication from Henry Bischoff, justice, supreme court, New York city, dated February 10, 1902, relative to the transfer of Edward Kenny from a position in the office of the county clerk of New York county to a position in the supreme court, together with the consent of County Clerk Hamilton to said transfer, and other correspondence relative thereto, was presented. The following resolution was adopted:

Resolved, That the transfer of Edward Kenny from the position of limited partnership and duces tecum clerk in the office of the county clerk of New York county, to the position of attendant in the supreme court, first judicial district, be and hereby is approved, it appearing that said Kenny has served with fidelity as limited partnership and duces tecum clerk in the office of the county clerk of New York county for more than three years, and that the qualifications required for the position of court attendant are not essentially different from or higher than those required for the position now held by said Kenny. Transfer of Joseph F. Blackgrove

A communication from Edward W. Hatch, justice, supreme court, appellate division, New York city, dated February 13, 1902, requesting the approval of the Commission to the transfer of Joseph F. Blackgrove from the position of attendant in the municipal court, fourth district, to the position of attendant in the supreme court, appellate division, and transmitting consent of Justice Roesch to said transfer, was considered. On motion the following resolution was adopted:

Resolved, That the transfer of Joseph F. Blackgrove from the position of attendant in the municipal court of the city of New York, fourth district, to the position of attendant in the supreme court, appellate division, first department, be and hereby is approved, it appearing that Mr. Blackgrove passed the required examination conducted by this Commission and was appointed to the position of attendant in the municipal court August 13, 1899.

Transfer of Isaac Rice

A communication from Surrogates Fitzgerald and Thomas, New York county, dated March 3, 1902, requesting the transfer of Isaac Rice from the office of the register of New York county to the surrogates' court, together with a communication from John H. J. Ronner, register, consenting to said transfer, was considered. On motion the following resolution was adopted:

Resolved, That the transfer of Isaac Rice from the position of clerk in the office of the register of New York county to the position of record bond clerk in the surrogates' court of said county, at a salary of $1,000 per annum, be and hereby is approved, it appearing to the satisfaction of the Commission that the duties of the two positions are similar.
