Overtime shall be distributed without discrimination; men shall not be laid off during the regular working hours to equalize their time on account of having worked overtime.

Note-It was requested that question of bulletin hours and time of men called after working hours should begin when men were called instead of when men reported for duty, but upon request the matter was held in abeyance for future consideration.

Rule 3-Men sent out on the road for temporary service will be paid single time between the hours of 7 a. m. and 5 p. m. and time and one-half between the hours of 5 p. m. and 7 a. m. and actual expenses of not to exceed $1.50 per day will be allowed.

Rule 4-Apprentices-An apprentice engaging himself to learn a trade shall be not less than 16 or more than 21 years of age, and shall have equal to a common or grade school education, and shall serve four consecutive years of not less than 300 days per year. He will be instructed in all branches of his respective trade and shall not leave the service of the company without just and sufficient cause until his apprenticeship is completed. If after six months' trial he fails to show proficiency he will be transferred or dismissed from the service of the company.

Note The following rule will govern after the apprentices under contract with the Fort Smith & Western have been advanced to journeymen: There may be one apprentice at large for each shop and in addition not more than one apprentice for each five journeymen employed. Laborers and helpers shall not be permitted to do journeymen's work.

Rule 5-A man advanced to a position for five days or more, paying a higher rate, shall receive the higher rate.

Rule 6-Shop employes to be given same consideration with respect to free transportation as other employes of the company.

Rule 7-Suspension and Dismissal: Employes will not be suspended or dismissed without sufficient cause, and if, after proper investigation, it is proven that any employe has been suspended or dismissed unjustly he will be reinstated and paid for all the time lost.

Employes are privileged to call attention of foremen to any case in which they feel they have been or are being unjustly treated, and are privileged to appeal to the next highest official in rotation to the vice president. Appeal must be made within five days after suspension or dismissal and investigation will be started within five days after filing appeal.
