Dr. 00 To the Board of Examiners of the State of California: the The undersigned, your petitioners, respectfully represent, that in year 1880, they entered in a contract with the Board of Directors of the State Insane Asylum, located at Stockton, California, to do the entire work upon the new addition to the State Insane Asylum at that place, then about to be erected under the provisions of an Act of the Legislature of the State of California, entitled "An Act to provide for the erection of a building for the insane at the State Insane Asylum at Stockton," approved April 15, 1880. That under said contract they were to receive monthly for their services ninety per cent of the value of their work done under the provisions of their said contract, and the balance upon the completion of the said build. ing upon which they were working. That the value of their work under said contract, due on the eighth of April, 1881, in addition to the amount of the first charge for services rendered, was $6,944; that ninety per cent of said amount is $6,249 60. That on or about the said eighth day of April, 1881, the State Controller, at the request of the Board of Directors of the said State Insane Asylum, drew his warrant upon the State Treasurer of California in favor of your petitioners for the sum of $6,249 60, and delivered the same to your petitioners. That your petitioners afterward presented said warrant to the State Treasurer of California for payment, and payment thereon was refused by the said Treasurer, for the reason that there was no money in the General Fund, upon which said warrant was drawn, to pay said warrant, and said warrant was returned to your petitioners. That your petitioners, in performing said work and labor hereinbe fore mentioned, had in their employ and under their pay a large number of workmen, and the amounts due from the State for their labor aforesaid, was necessary to pay the workmen under petitioners' employ upon said work. That by reason of the failure of the State Treasurer to pay the said Controller's warrant, it became and was actually necessary for your petitioners to negotiate said warrant and obtain therefor the largest amount of money possible, in order to prosecute their contract entered into as aforesaid. That it was impossible to obtain for said Controller's warrant & larger sum than $5,999 60, and your petitioners sold said warrant for the sum of $5,999 60. That by reason of said sale and the lack of money in the General Fund of the State, your petitioners lost the sum of $250, no part of which has ever been repaid to them. That said sale was necessary, and would not have been made if the said Controller's warrant had been paid by the State Treasurer. Wherefore your petitioners pray that they may be allowed from the State General Fund the sum of $250, and that the State Controller be directed to draw his warrant for that sum in favor of your petitioners.
