1/ The appeals to the Federal Employee Appeals Authority shown in this table are from actions taken on or after September 9, 1974, when Executive order 11787 established the Commission's system as the sole appeals system. Regulations (5 CFR 772) which effected these changes provide that either party may request the Appeals Review Board to reopen and reconsider the FEAA decision under specific, limited criteria.

1/ At the first appellate level adverse action, reduction in force, suitability, disability retirement and "all other" appeals were processed by the Federal Employee Appeals Authority under regulations in effect prior to September 9, 1974; classification and performance rating appeals were processed by the Bureau of Personnel Management Evaluation and Personnel Management and Evaluation Divisions in the regional offices; examination rating appeals were processed by the Appeals Review Board.

2/ At the second appellate level classification appeals were processed by the Bureau of Personnel Management Evaluation and all other types of appeals were processed by the Appeals Review Board. Adverse action, reduction in force, suitability, disability retirement and some of the "all other" appeals were processed under regulations in effect prior to September 9, 1974.

3/ Discrimination complaints, at the first level are not appeals but represent the hearings conducted for the agencies by the Federal Employee Appeals Authority. These resulted in findings and recommendations to the agencies. Those listed under second level were agency decisions appealed to the Appeals Review Board.
