Dalyson and Tuthill.*

CLOSE ROLL, 34 ELIZABETH, PART 8 (No. 1412).

This Indenture made the fourth daye of Marche in the eight and twentith of the raigne of our soveraigne Lady Elizabeth by the grace of God of England Fraunce and Ireland Queene defendor of the faith etc. Betwene William Tuthill of Newton next Norwich in the Countye of Norff" gent' on thone partie and Roger Dallison esquier sonne and heyre apparant of William Dallyson of Laughton in the Countie of Lincolne Esquier on thother partie Witnesseth that where the said William Tuthill in consideracion of a marriage before this tyme had & solempnized betwene the said Roger Dallyson & Elizabeth Tuthill daughter of the said William Tuthill lately deceased hath heretofore by good & lawfull conveyance and assurance in the lawe lawfully conveyed & assured all that his moyetie of the Mannor of Netherhall in Saxlingham with thapp'tenances in the said Countie of Norff' and all the messuages landes etc. of the said William Tuthill in Saxlingham aforesaid to c'ten uses mencioned lymited and exp'ssed in c'ten Indentures trip'tite made betwene the said William Dallison and Roger Dallison on the fyrste part and the said William Tuthill on the second and Thomas Bateman John Meres and Rob't Dymock esquiers on the third part bearing date the nynth daye of November in the three and twentith yere of the Raigne of our said sou'aigne lady the Queenes maiestie that nowe ys That is to saye to thuse of the said William Tuthill and Elizabeth nowe his wife for & during the terme of the naturall lyves of the said William Tuthill and Elizabeth his wife and for and during the terme of the naturall life of the longer liver of them without ympeachment of anye manner of waste during the life of the said William Tuthill. And after the decease of the said William Tuthill and Elizabeth his wyfe then to the use of the said Roger Dallyson and the said Elizabeth daughter of the said William Tuthill & of the heyres of the said Elizabeth the daughter by the said Roger Dallison on the bodye of the said Elizabeth the daughter lawfully begotten And for default of such yssue to thuse of the right heyres of the said William Tuthill forever etc. And where sithence the tyme of the making of the said Indenture & other conveyances & assurances of the said moyetie of the said Mannor of Netherhall & other the p'misses to the uses aforesaid & after marriage had betwene the said Roger Dallyson & the said Elizabeth the daughter of the said William Tuthill she the said Elizabeth dep'ted this p'sent lyfe without yssue of her bodye begotten by the said Roger Dallyson her husband. And whereas by force of the said Indenture etc. the said William Tuthill and Elizabeth his wife do nowe stand & are seased of the said moytie of the said Mannor of Netherhall etc. during the terme of the naturall lives of them the said William Tuthill and Elizabeth his wife for & during the terme of the naturall lyfe of the longer liver of them the Remainder thereof to the said Roger Dallison for terme of the naturall lyfe of the said Roger the reversion or remainder of the fee symple of all & singuler the said p'misses being in the right heyres of the said William Tuthill in such manner & forme as in the said Indenture trip'tite is mencioned & exp'ssed. affeccion & good will which he the said William Tuthill beareth to the said Roger and in hope that the said Roger Dallison will contynue loving kinde and frendlye towardes the said William Tuthill & the said Elizabeth his wife during theyr lives together as alsoe for c'ten other consideracions hereafter in these p'sentes mencioned hath given & graunted & by these p'sentes for hym his heyres & assignes doth fully & clerely give & graunt unto the said Roger Dallyson his heires & assignes the said reversion or remainder of the fee symple of the said p'misses or of every part & parcell thereof with thapp'tenances unto the said Roger Dallison his heyres & assignes to thonely & p'per use & behoofe of hym the said Roger Dallyson his heyres & assignes forever upon & under p'vision condycion & lymitacion hereafter in these p'sentes mencioned and exp'ssed. Provided alwaies & yt is agreed betwene the said parties to these p'sentes That yf the said William Tuthill at any tyme hereafter during his life shalbe det'mined to make a revocation of the said guift & grant etc. these p'sentes all covenantes grauntes & agreementes therein conteined shall cease and det'myn etc. And the said Roger Dallyson for hym self etc. doth covenant & graunt to & with the said William Tuthill his heyres etc. that yf the said William Tuthill shall not at any tyme during his lyfe make revocacyon of the said guift etc. That then he the said Roger Dallyson his heyres etc. shall & will well and truly content and pay or cause to be contented satisfied and paied all such legacies and som'es of monye as the said William Tuthill by his last will and testament in writing shall give and bequeath to any p'son or p'sons & which the said William Tuthill by his said last will shall sp'iallye assigne and appoint the said Roger Dallyson to paye not exeding in the whole the som'e of three hundred pound etc. Sealed and delyvered in the presence of Ry. Godfrey, William Dighton, Richard Kylbeck, Thomas Burey and others.

Sacred to the Memory | of | Lieutenant-General | SIR MANLEY POWER, K.C.B., K.T.S. who after a distinguished course of long and honorable service | departed this life at Bern July 7th 1826 | aged 53 years.

Sacred to the Memory of CHARLOTTE | daughter of the Reynd WILLIAM TYNER, M.A. | Vicar of Compton cum Up Marden | in the county of Sussex | who died in Berne | on the 8th day of November 1827 | Aged 25 years.

Sacred to the memory of COLINETTE MCNEIL the virtuous and amiable wife of THOMAS BOURKE, Esqre, of | Mayo, Ireland, and of Jamaica, | who after fulfilling with the tenderest affection | for nearly fifty years all the duties of a wife and Mother | departed this life at Berne | 22nd December 1831, aged 64, | beloved, respected, and | lamented by all who knew her.

Sacred also to the Memory of | THOMAS BOURKE who departed | this life at Eichenpomusch in Russia 4th November | 1832, aged 81.

Sacred to the memory of | PHILIP ROBIN, Esqe of the Island of Jersey | who departed this life | at Berne | the 17th April 1841 | aged 71 years.

Sacred to the memory of | EDWARD MADDEN | of Spring Grove | in county of Fermanagh, Ireland | Esquire | who died at Bern | after a short illness | the 25th of October 1842 | aged 26 years.
