CHAPTER 43.

COURTS-COUNTY COURT AT WESTVILLE.

AN ACT to provide for holding sessions of the county court at Westville, Adair county, Oklahoma, and prescribing the duties of the county judge and the county attorney in relation thereto, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Terms-Probate Business.

Section 1. That after the passage and approval of this Act, there shall be three terms of the county court of the County of Adair, Oklahoma, held in each year in the City of Westville, said term shall begin on the first Monday in February, May and November; and each term shall continue for a period of one week, or until the business of the term is disposed of; Provided, that said court shall always be open for probate business. The county judge of Adair county is hereby required to spend as much time as is necessary in holding court in Westville in addition to the regular terms herein provided for, for the purpose of holding probate court and the transaction of other matters as may properly be brought before said court, and the court is hereby authorized and required to designate by proper order the day or days of each week on which he will transact business in said City of Westville.

Jurisdiction-Litigants to Choose.

Section 2. The said court held at Westville, Adair county, Oklahoma, shall have original jurisdiction as the county court co-extensive with the entire county; provided, that upon application presented after reasonable notice any action or matter pending in either court, shall be transferred to the county court held in said county most conven-. ient to the litigants interested in said action; and provided, further, that any case of probate of wills, guardianship, administration, and other probate matters, upon application of said parties shall be transferred to the county court in said county, held nearest the residence of such guardian, executor or administrator.

Deputy Clerk at Westville-Appointment and Salary.

Section 3. Upon the taking effect of this Act, it shall be the duty of the court clerk of said County of Adair, to appoint a deputy clerk of said county court, who shall at all reasonable hours, keep the office open at Westville; and said clerk is hereby authorized to issue process and perform all other ministerial acts as are performed, and as are required of court clerks of said state, said clerk shall receive a salary of not more than six hundred dollars per annum to be fixed by the board of county commissioners, shall be paid in like manner as the salary of the court clerks.

Records.

Section 4. The judge of the county court of Adair county, shall keep all necessary papers, books and records of his office, relating to any cause pending before his court, at the office where said cause has been filed or transferred.

Expenses of Judge and County Attorney.

Section 5. The county judge, county attorney and county court stenographer of said County of Adair, shall be paid out of the county treasury of said county their actual necessary traveling and hotel expenses incident to the holding of court at the said city of Westville; such payments shall be made by the order of the board of county commissioners on an itemized and verified account in the manner now provided by law; and it shall be the duty of the county attorney of said Adair county to attend said county court upon its sittings at the City of Westville, in all actions and matters pertaining to the duties of his office.

Appeals to Designate Place of Trial.

Section 6. All appeals from judgments of the justice of the peace shall be taken to the district court or county court designated by the appellant in his appeal bond.

Jury List of Westville.

Section 7. The jury commissioners of Adair County are hereby authorized and directed to select the jurors for the county court sessions to be held at Westville from the

following voting precincts: Chance, one and two; Ballard, one, two and three, Westville, one and two. Christie, one and two, Baron, one, two and three.

Court Room.

Section 8. Before any session of the county court shall be held at Westville, a proper and comfortable court room shall be furnished at a rental not to exceed seventy-five dollars per annum, also all necessary vaults, lights, fuel and

water.

Repeal of Conflicting Acts.

Section 9. All acts and parts of acts in conflict herewith are hereby repealed.

Emergency.

Section 10. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof, this Act shall take effect and be in force from and after its passage and approval.

CHAPTER 44.

TAXATION-RAW FARM PRODUCTS EXEMPT-INCOME TAX.

AN ACT to amend section 7302 of the Revised Laws of Oklahoma, annotated, of 1910, and repealing all laws in conflict therewith, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Farm Products Exempt from Ad Valorem Tax.

Section 1. Section 7302, Revised Laws of Oklahoma, Annotated, of 1910, is amended to read as follows:

All property in this state, whether real or personal, including the property of corporations, banks and bankers, except such as is exempt, shall be subject to taxation; provided, that no farm products while remaining in the raw

state, such as cotton, corn, wheat, oats, and the like, shall be subject to ad valorem tax, but be subject to the income tax laws of the state.

Emergency.

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in force from and after its passage and approval.

CHAPTER 45.

NEWSPAPER NOTICE-LEGAL PUBLICATIONS.

AN ACT relating to publication of legal notices.

Be It Enacted by the People of the State of Oklahoma:
How Designated.

Section 1. In all cases provided by law for the publication of notice in a newspaper, the party or attorney upon whose application or behalf the notice shall be published shall have the right to designate the newspaper in which such publication shall be had, and it shall be the duty of the officer whose duty it shall be to sign or certify to such notice to have the publication in the newspaper so designated, and no other; provided such newspaper shall come within the provisions of section 2954 of the Revised Laws of Oklahoma, 1910.

CHAPTER 46.

PUBLIC LANDS-CONSENT OF STATE-ACQUISITION-PUBLIC PURPOSES.

AN ACT to amend section 3190 of the Revised Laws of 1910, relating to acquisition by purchase or condemnation proceedings of real estate for the use of the United States government.

Be It Enacted By the People of the State of Oklahoma:

Lands-State Consent to United States Acquisition.

Section 1. Section 3190 of the Revised Laws of Oklahoma 1910, is hereby amended to read as follows:

Section 3190. The consent of the State of Oklahoma is hereby given, in accordance with the seventeenth clause, eighth section, of the first article of the Constitution of the United States, to the acquisition by the United States, by purchase, condemnation or otherwise, of any land in this state required for sites for custom houses, postoffices, arsenals, forts, magazines, dockyards, military reserves, forest reserves, game preserves, national parks, irrigation or drainage projects, or for needful public buildings or for any other purposes for the government.

CHAPTER 47.

TAXATION-SALE OF REAL ESTATE FOR TAXES PROCEDURE.

AN ACT amending section 7412, of chapter 72, of article 9, of the Revised Laws of Oklahoma of 1910.

Be It Enacted By the People of the State of Oklahoma:

Issuance of Tax Deeds-Notice-Recitals.

Section 1. Section 7412, of the Revised Laws of 1910, is hereby amended to read as follows:
