Mr. STEVENS (for himself and Mr. GRAVEL) introduced the following bill; which was read twice and referred to the Committee on Interior and Insular Affairs

A BILL

To deal with the current energy crisis and the serious shortages of petroleum products facing the Nation and to authorize construction of the trans-Alaska pipeline.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Trans-Alaskan Pipeline 4 Authorization Act of 1973".

SEC. 2. The Congress hereby finds that

(a) the United States is currently experiencing a

critical shortage of petroleum supplies;

(b) this shortage has resulted in the closure of schools and factories, created unemployment in many

regions of the country, and disrupted truck, rail, and air

transportation systems;

(c) reliance upon imported oil products to fill the growing gap between domestic supply and increasing

demand is not in best interests of the United States and

is creating a serious national security problem and a critical imbalance in the Nation's balance of payments;

(d) the action of Canada in restricting crude oil imports into the United States and the announced policy of other exporting nations to limit oil production makes clear that the United States must take immediate action

to increase domestic petroleum sources and provide the

necessary transportation systems to bring domestic oil to the American consumer.

SEC. 3. Notwithstanding any other provision of law, 16 the trans-Alaska pipeline (as set forth in the right-of-way 17 permit application or applications submitted to the Secretary 18 of the Interior by Alyeska Pipeline Corporation and all related documents) is hereby authorized, and such permit 20 application and related documents are deemed to be in ac21 cordance with applicable Federal law. The Secretary of 22 the Interior is authorized and directed to issue, in accordance 23 with such permit application or applications, a right-of-way 24 permit granting such easements, rights, and interests as are 25 necessary for the construction of the trans-Alaska pipeline.

SEC. 4. The Congress finds and declares that the state2 ment prepared by the Secretary of the Interior pursuant to 3 section 102 (2) (C) of the National Environmental Policy 4 Act of 1969 with respect to the granting of a permit for the 5 trans-Alaska pipeline meets the requirements of such Act. SEC. 5. Any finding, determination, or decision of the 7 Secretary of the Interior, or any other Federal official of any 8 agency, with respect to the legal authority to permit the 9 construction of the trans-Alaska pipeline, shall be final and 10 shall not be subject to review in any court of the United 11 States.

SEC. 6. The Secretary of the Interior is authorized to 13 issue such regulations as he may determine necessary to 14 enable him to carry out the provisions of this Act.

A BILL

To authorize the Secretary of the Interior to issue rights-ofway and special land use permits for the construction of pipelines in the State of Alaska under certain circumstances, and for other purposes.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, SECTION 1. Notwithstanding section 28 of the Mineral

4 Lands Leasing Act of 1920 (30 U.S.C. 185), and any 5 regulations issued pursuant to that section, the Secretary 6 of the Interior is authorized to issue such rights-of-way and 7 special land use permits as are necessary for the construction,

3 operation, and maintenance of pipelines for the development

of the oil and natural gas resources in the vicinity of Prudhoe

1 Bay in the State of Alaska, along the shortest feasible

2 direct route from Prudhoe Bay, Alaska, to the border be

tween the State of Alaska and Canada.

SEC. 2. Within sixty days of passage, the Secretary of

5 the Interior, in accordance with the National Environ6 mental Policy Act of 1969 (42 U.S.C. 4321 et seq.), is 7 hereby directed to initiate intensive investigation of the 8 feasibility of a trans-Canadian pipeline route as the means 9 of transporting the oil and natural gas resources of the 10 Prudhoe Bay region in the State of Alaska to the United 11 States.

SEC. 3. Such rights-of-way and special land use permits as authorized by section 1 may be issued by the Secretary 14 of the Interior only after he has complied with all applicable 15 provisions of the National Environmental Policy Act.
