Comrades Hogan and Roberts subsequently resigned their membership upon said committee by reason of which fact the entire effort was carried on by Comrade White as chairman of said committee and so reported to the following or Twenty-sixth National Encampment, held in Michigan City, Ind., September, 1924, in substance, that the work undertaken by said committee was of such greater import and required much more time and labor than was afforded; that the distances between the committee members and its inability to function, more time was requested (see pps. 222-3, proceedings of the Twenty-fifth Annual Encampment, United Spanish War Veterans). Whereupon the said encampment directed that the committee be retained and given further time to complete its work, etc.

Subsequently and by an arrangement with and authority of Commander in Chief Chauncey W. Herrick, the resignation of Comrade Roberts was formally accepted and an additional vacancy on the committee declared by reason of absence and inability of Comrade Hogan to function. Later Comrade Philo M. Hoyt, Illinois, it was agreed, should fill one of the two vacancies thus created.

Therefore the committee under Comrade Edward H. White, Illinois, as chairman, having completed its work in compliance with the authority hereinbefore set forth, respectfully submits to the Twentyseventh National Encampment, United Spanish War Veterans, at St. Petersburg, Fla., September 27-October 1, 1925, the by-laws, rules, and regulations for the government of the Sons of SpanishAmerican War Veterans as follows:

RULES AND REGULATIONS OF THE SONS OF SPANISH-AMERICAN WAR VETERANS

(By authority of Twenty-fifth National Encampment, United Spanish War Veterans, by the committee, Edward H. White (Past Judge Advocate General, United Spanish War Veterans), chairman.)

ARTICLE I

NAME

SECTION I. The name of this organization shall be "Sons of Spanish-American War Veterans."

ARTICLE II

PURPOSES AND OBJECTS

SECTION I. To perpetuate the memory of the services of veterans of the Spanish-American War, the Philippine insurrection, and the China relief expedition, and of such others as may now be or hereafter become affiliated or allied with the United Spanish War Veterans.

SEC. II. To ascertain and tabulate, so far as possible, all data relating to service, death, and place of burial of the aforementioned veterans, and to chart and file the said information in such form and manner as may be best suited to the observances, rituals, or ceremonials of the United Spanish War Veterans. SEC. III. This organization pledges itself to keep constantly on the alert regarding the condition of dependent relatives of veterans of all United Spanish War Veterans and to assist, whenever possible and proper, in the prosecution of pension or other like claims, including claims for subsistence, hospitalization, or habitation.

SEC. IV. To promulgate the principles of freedom, patriotism, and humanity; to assist in proper observance of Memorial Day and other days commemorating the events of the Spanish-American War, the Philippine insurrection, and the China relief expedition; to promote public sentiment and proper respect for all such services among the school children of the general public whenever and wherever possible.

SEC. V. To assist all veterans of the Spanish-American War, the Philippine insurrection, and the China relief expedition in their entire fraternal endeavors, and to render such other and further assistance to the United Spanish War Veterans as may from time to time be desirable, especially in the promotion of its legislative endeavors and its activities for its fraternal and material welfare.

SEC. VI. To assist to the fullest degree in the education of its membership to a true and proper undersanding of American principles and American history pertaining to its military and naval prowess.

SEC. VII. To assist in promulgating a proper observance of the usages of the flag of the United States of America; obedience to its laws and respect to its magistrates of the several communities thereof, and to assist in the prosecution for breaches thereof.

ARTICLE III

ELIGIBILITY TO MEMBERSHIP

SECTION I. Male descendents, whether through the paternal or maternal line, all sons of the men who served during the Spanish-American War, the Philippine insurrection, and the China relief expedition, who have attained the age of 12 years, shall be eligible to membership in this organization: Provided, however, That eligibility to membership herein shall be restricted to the sons of men who were honorably discharged from the service of the Army or Navy of the United States of America.

ARTICLE IV

RELIGION AND POLITICS

SECTION I. This organization shall be absolutely nonpartisan and nonsectarian and shall not be used for the dissemination of partisan political, or sectarian principles, or for the promotion of the candidacy of any person seeking public office.

ARTICLE V

ORGANIZATION

SECTION I. The several constituted units of this organization shall be as follows:

A. Of units known as camps, each of which shall bear a name and number, and there shall be but one camp in each city or community of any State or department.

B. Of State organizations known as departments, each to bear the name of the State in which established.

C. Of a supreme or national organization known as national headquarters, Sons of Spanish-American War Veterans.

SEC. II. This organization pledges itself in its entirety to be governed by and entirely subordinate to the constitutional principles of the United Spanish War Veterans and to remain subordinate thereto at all times.

ARTICLE VI

FORMATION AND DISBANDMENT

SECTION I. A camp may be formed by authority of the department commander, United Spanish War Veterans, and created and established with the approval of the commander in chief, United Spanish War Veterans, but no camp shall be chartered unless the petition for said charter shall have been signed by at least 20 applicants whose qualifications shall have been previously determined and accepted by the department commander of each department of the United Spanish War Veterans and approved by the commander in chief, United Spanish War Veterans. A minimum charter fee of $20 shall accompany each application for a camp charter.

SEC. II. Departments or State organizations and the national organizations may be created and established by the commander in chief of the United Spanish War Veterans, with the advice and consent of the national council of administration, as follows:

A. For a department or State organization when there shall have been not less than 10 camps established and in actual operation, a minimum charter fee of $50 shall accompany each application for a department charter.

B. For the national organization when there shall have been not less than 20 of the departments or State organizations in as many of the States of the United States of America created and in actual operation, a minimum charter fee of $100 shall accompany the application for the charter of the national organization.

SEC. III. Camps organized in States where no department organization exists and departments organized prior to the creation and establishment of the national organization of the Sons of Spanish-American War Veterans shall be attached to and carried by the national headquarters, United Spanish War Veterans, the officers of which shall respectively function until the national organization of the Sons of Spanish-American War Veterans shall have been fully accomplished and all just expenses in that behalf incurred, fully satisfied or otherwise canceled by the national council of administration of the United Spanish War Veterans.

SEC. IV. The commander in chief, United Spanish War Veterans, by and with the advice and consent of the national council of administration, shall have the power to suspend, revoke, or to reinstate the charter of any camp or department for cause.

SEC. V. All charters issued to the national organization, Sons of SpanishAmerican War Veterans, or to any subordinate unit thereof, shall be engrossed with its official seal, the signature of its commander in chief, and the attest of the adjutant general, United Spanish War Veterans.

ARTICLE VII

MEMBERSHIP

SECTION I. Regulations for the admission of applicants, for transfer cards, honorable discharge, time and conduct of meetings, ritualistic ceremonies, the changing of the location of a camp or camps, of a department or departments, or consolidation thereof, the duties of the several officers and their responsibilities, the adoption of local by-laws, etc., not in conflict with Article III hereof, and all proposed amendments or changes to these regulations shall be as promulgated by the commander in chief, United Spanish War Veterans, by and with the advice and consent of the national council of administration of the United Spanish War Veterans, and shall conform to the rules and regulations of the United Spanish War Veterans.

ARTICLE VIII

COLORS

SECTION I. The colors of the Sons of Spanish-American War Veterans shall be carmine red, chrome yellow, and flag, blue.

ARTICLE IX

GENERAL

SECTION. I. No camp or department of this organization shall at any time make or propose any legislation or proposition for the appropriation of public moneys in the name of the organization unless the same shall have first been submitted to the commander in chief, United Spanish War Veterans, and shall have received his approval, provided, however, The said camp or department shall have the right of appeal to the national council of administration of the United Spanish War Veterans.

SEC. II. Any member in good standing of the United Spanish War Veterans, or of the auxiliaries thereof, shall at all times have access to any general or special meeting of the several units of the Sons of Spanish-American War Veterans: Provided, however, That such member or members of either of the said organizations shall take no part in the discussion of its business affairs unless upon invitation, and shall not at any time have the right to vote.

SEC. III. No members of this organization shall at any time have the right or permission to wear or carry the emblems of the United Spanish War Veterans, other than as members of this organization.

SEC. IV. This organization shall not adopt or use any of the emblems of the parent organization. Nor shall the United Spanish War Veterans or its auxiliaries be in any wise accountable or responsible for the acts or liabilities of this organization or any unit thereof.

SEC. V. This organization may adopt as its emblem, a pin, ring, or like ornament, provided same does not conflict with any of the emblems of the parent organization and subject to the approval of the commander in chief, United Spanish War Veterans.

SEC. VI. The officers of the National organization of the Sons of SpanishAmerican War Veterans shall be a national president, national senior vice president, national junior vice president, national secretary, national treasurer, national sergeant at arms, national chaplain, and a board of trustees, who shall be elected annually, and who shall hold their offices for the period of one year or until their successors are duly elected and qualified, and who are severally pledged then and there to turn over to their successors all paraphanelia, moneys, and accoutrements used and acquired for the purpose of said organization; and a memorial committee, debating or historical committee, and such other committees, such as investigating, entertainment, or special committees, as may, in the opinion of the organization be deemed necessary for the conduct of its affairs. The above general outline or provision for officers and committees for the National organization shall apply generally to subordinate units thereof with modification to conform to units, etc. SEC. VII. The memorial committee shall arrange the ceremonies in connection with memorial activities of all sorts, the erection of monuments, the placing of markers on the graves of the deceased who have honorably served in the Spanish-American War or in the incidents thereof; the placing of flowers or other decorations on ceremonious occasions, and to assist in the burial ceremonies for veterans of the aforementioned wars.

SEC. VIII. The debating or historical committeee shall consider and act upon all incidents of the aforementioned wars from an historical standpoint and shall promulgate and inspire proper regard for the various actions emanating from or during the said wars, or of those contributory acts concerning the same and of those incidents in our civic or military activities emanating therefrom.

SEC. IX. Salaries or other compensation for officers of this organization shall be governed by the local units of the organization exclusively; Provided, however, That such local units shall pay salaries or other like compensation to only the secretary thereof, at its option.

ARTICLE X

REVENUE

SEC. I. The revenue for the maintenance of this organization shall be derived from the assessment of annual dues, inititation or like fees, or from profits from entertainments or by voluntary donations to its funds.

SEC. II. The initiation fee for charter members shall be fixed at $5 for each applicant to the charter, and $7.50 for each applicant for membership after the said charter shall have been closed.

SEC. III. Upon every and each member obtained after a charter shall have been closed there shall be the sum of $1 charged to and deducted from the initiation fee, which shall be forwarded at once to the national organization of the United Spanish War Veterans.

RESOLUTION No. 21

(Presented by the committee on resolutions.)

Be it resolved, That the United Spanish War Veterans in national encampment assembled do hereby disapprove the discrimination against Spanish War veterans under the existing law which takes from them five-sixths of their pension during the period of their confinement in St. Elizabeths Hospital at Washington, D. C., and any other Government hospitals where the practice prevails, and that the matter be referred to the national legislative committee for remedial action.

RESOLUTION No. 22

(Presented by Hugh J. McGrath Camp, No. 4, Department of Wisconsin.) Whereas the ex-service men of the United States Army, Navy, and Marine Corps freely gave their lives, health, and loyalty to this Government in time of great need, and freely performed all duties attached thereto, having served their enlistment and having been honorably discharged from such service for reasons given by the Government in their discharge papers; and

Whereas such honorably discharged ex-service men are now in poor health, and are now being cared for in national homes where they are designated as "inmates" of said homes in all reports and other written messages; and

Whereas county almshouses, county and State insane asylums, and all penal institutions use the word "inmate " for such as are confined or admitted to said institutions: Therefore be it

Resolved by the United Spanish War Veterans, assembled in national encampment at the city of St. Petersburg, Fla., That the incoming administration be directed to take this matter up with the proper authorities, to have the word "inmate" stricken from all orders and communications and that it be eliminated hereafter and the word "member" be substituted, where such word or words refer to men having served in the Army, Navy, and Marine Corps of the United States of America.

Whereas the city of St. Petersburg and the State of Florida, its officials and citizens, and General Leonard Wood Camp No. 8, United Spanish War Veterans, Department of Florida, the several veteran, fraternal, and civic organizations have been the hosts of the Twenty-seventh National Encampment, United Spanish War Veterans; and

Whereas the hospitality extended has been of such a character as to endear the people of St. Petersburg and Florida to the hearts of the comrades: Now, therefore, be it

Resolved, by the National Encampment of the United Spanish War Veterans in convention assembled, That we extend our hearty thanks to Mayor Blanc, Chief Vaughn, and the police department, and the other city officials of St. Petersburg, and its entire citizenry, and to the people of Florida for the royal entertainment accorded us; and express our appreciation of their many courtesies and kindnesses.
