Before a general court-martial which convened at Cebu, Cebu, Philippine Islands, pursuant to Special Orders, No. 2, Department of the Visayas, April 20, 1900, and of which Major JOHN G. LEEFE, 19th Infantry, was president, and Captain EDWARD A. STUART, adjutant, 44th Infantry, U. S. Volunteers, was judge advocate, was arraigned and tried

Private Phineas Foutz, Company K, 19th U. S. Infantry. CHARGE. "Murder, in violation of the 58th Article of War." Specification—“In that Private Phineas Foutz, Company K,

19th Infantry, did enter the house of one Florentina Cenza, a native, and did then and there wilfully, feloniously, and with malice aforethought kill and murder Geneviva Torres, a native girl, by stabbing the said Geneviva Torres with a sword cane held in the hands of the said Phineas Fontz, private, Company K, 19th Infantry, inflicting wounds whereof the said Geneviva Torres then and there died. This in the house of the aforesaid Florentina Cenza, at Mandaue, Province of Cebu, Philippine Islands, about 5:30 p. m., November 15, 1900, then as now, a time of insurrection against the United States."

And the court does therefore sentence him, Private Phineas Foutz, Company K, 19th Infantry, "To be hanged by the neck until he is dead, at such time and place as the proper authority may direct; two-thirds of the members of the court concurring therein."

The sentence in the foregoing case of Private Phineas Foutz, Company K, 19th Infantry, having been approved by the proper

reviewing authority and the record of the proceedings forwarded to the President the following are his orders thereon:

EXECUTIVE MANSION, July 30, 1901.

In the foregoing case of Private Phineas Foutz, Company K, 19th Infantry, the sentence is confirmed and will be duly carried into execution at such time and place as may be designated by the commanding general. Department of the Visayas, Philippine Islands.

ADJUTANT GENERAL'S OFFICE,

Washington, August 8, 1901.

I. By direction of the Secretary of War, the accompanying tables of the price of clothing and equipage, and of tableware and kitchen utensils, for the Army of the United States, with the money allowance for clothing of the enlisted men for each year and day; the price of clothing and special clothing money allowance for troops stationed in Alaska, also of the allowance of equipage and of tableware and kitchen utensils, is published for the information and guidance of all concerned, to take effect October 1, 1901, and to remain in force until further orders.

Clothing and equipage purchased in Manila for service in the Philippine Islands will be charged at invoice or cost prices.

A table showing existing relations between the commercial sizes of clothing and those furnished by the Quartermaster's Department is also published for the information of officers making requisitions.

II. By direction of the Secretary of War, paragraph 1311 of the Regulations is amended to read as follows:

1311. Leggings for all troops of cotton duck, according to color and pattern in the office of the Quartermaster General, will be worn on marches and campaigns.

They will form part of the annual clothing money allowance and be charged to the enlisted men at cost price.
