MUNICIPAL CIVIL SERVICE COMMISSION.

Minutes of Meeting of the Municipal Civil Service Commission of New York, Held at the Commission's Offices, No. 299 Broadway, on Wednesday, April I, 1908, at 10 a. m.

Present-President Frank L. Polk and Commissioners R. Ross Appleton and Arthur J. O'Keeffe.

The President, Mr. Frank L. Polk, presided.

Patrick Campbell, of No. 131 Butler street, Brooklyn, again appeared before the Commission, as directed, to show cause why his appointment as Patrolman in the Police Department should not be revoked, pursuant to the provisions of Rule XI., clause 6, on the ground that he was over thirty years of age at the time that his name was placed upon the eligible list. The hearing was adjourned for one week pending the calling of witnesses.

The Commission then went into regular session, and the minutes of the meeting held March 25 were approved.

On the recommendation of the Committee on Transfers, the following transfers were approved:

872. Hugh F. McLaughlin, Architectural Draughtsman, from the Board of Education to the Department of Docks and Ferries.

875. Joseph R. Walker, Clerk, second grade ($900 per annum), from the Department of Health to the office of the President of the Borough of Manhattan.

On the recommendation of the Committee on Transfers, the following transfer was disapproved:

Peter J. Quigley, from the position of Secretary of the Relief Fund (exempt class) to that of Clerk, fifth grade (competitive class), in the Fire Department.

On the recommendation of the Committee on Reinstatements, the following reinstatements were approved:

866. Isaac B. Zinn, in the position of Stenographer and Typewriter, third grade ($1,200 per annum), in the Department of Public Charities, as of March 25, 1908, he having resigned from a similar position on March 25, 1907.

869. Max Oppenheimer, in the position of Clerk, second grade ($750), in the Law Department, he having resigned from a similar position on June 30, 1907.

878. Meyer Krasner, in the position of Inspector of Meters and Water Consumption in the Department of Water Supply, Gas and Electricity, he having resigned from a similar position on March 31, 1907.

On the recommendation of the Committee on Reinstatements, the following reinstatement was disapproved:

867. Frank Nearing, in the position of Inspector of Masonry in the Department of Bridges, there being a preferred list for that position.

The Secretary presented for approval by the Commission, the request of the President of the Borough of Brooklyn for the transfer of James A. Sherry from the position of Clerk, second grade ($750 per annum, in the office of the Commission to that of Clerk, second grade ($1,050 per annum), in his Department. The transfer was approved, and the Secretary was directed to issue a certificate to that effect.

The President presented the following report on transfers, reinstatements, etc., in the Labor Class, acted upon by him:

Request of the Commissioner of Parks, Boroughs of Manhattan and Richmond, dated March 25, for approval of his action in rescinding the dismissal of August Vetting, Park Laborer, on January 30, 1908.

Request of the Commissioner of Parks, Boroughs of Brooklyn and Queens, dated March 28, for approval of his action in rescinding the dismissal of William Huber, Jr., Climber and Pruner, on March 16, 1908.

Applications Denied.

Request of the Board of Water Supply, dated March 27, for authority to reinstate George Grim and Daniel C. Lucey in the position of Laborer (Ulster County), they having resigned before completing their probationary period.

Request of the Commissioner of Bridges for authority to transfer Joseph T. Johnson from Hostler in the Department of Street Cleaning to Laborer in his Department, there being a preferred list for the latter position.

Request of the President of the Borough of Manhattan for authority to transfer John Daly from Saw Filer to Carpenter, there being a preferred list for the latter position.

The report was adopted.

The appeals of the following-named persons for a rerating of their examination papers were denied upon the recommendation of Chief Examiner, no errors of marking or rating having been indicated:

Dominick P. Brennan, No. 437 West Thirty-fourth street.

Martin J. Boyne, No. 636 Bergen street, Brooklyn.

The appeal of Martin Beck, of No. 18 Humboldt street, Brooklyn, for a physical re-examination for the position of Stoker, Borough of Brooklyn, was denied for lack of power.

A communication was presented from the Chief Examiner, forwarding report of Examiners Collingwood and Hildreth with reference to the appeal of Joseph W. Rogers, Brown's Station, N. Y., for a rerating of his papers in the examination for promotion to Assistant Engineer, Board of Water Supply, as follows:

"Regarding the above noted case, it appeared that the candidate answered the correct first half of the paper, but for the second half received and answered the second half of the paper for Water Supply, Gas and Electricity. Rated on both halves, he failed, solely because of incorrect answers to questions in the second half. Rated on the first half he would receive total 83.80, and technical, 77.76.

"While I believe that candidate should have been able to answer questions in the second paper, nevertheless, it is proper that he should have had the same test as his associates, and would probably have done better with questions relating more closely to his work. I therefore recommend that he be given an examination consisting of a new second sheet similar to the original second sheet."

The recommendation was adopted.

The appeal of James J. Melody, of No. 1830 Third avenue, Manhattan, candidate for Patrolman, that he be permitted to correct the date of birth appearing as August 6, 1881, in his application, to read October 6, 1881, to correspond with the birth certificate furnished by him, was granted.

The appeal of Edward J. Armstrong, Lieutenant, Two Hundred and Seventy-ninth Precinct, for a rerating of his record in the examination for promotion to Captain of Police, by giving him credit in same for an "honorable mention and medal," received on April 23, 1895, was granted.

The President, to whom had been referred the appeal of William J. Bierach, candidate for Court Stenographer, for a special speed test, presented for the consideration of the Commission a report of the Chief Examiner on the case to the effcct that it seemed to be covered by Rule VII., paragraph II, which stated that "No candidate shall be granted a second or special examination unless it be shown to the satisfaction of the Commission that his failure to appear for, or to gain admission to, or to complete such examination or test, was due to a manifest error or mistake for which the Commission is responsible," The appeal was denied.

The President, to whom the appeal of Michael T. Brennan, of Dover Plains, N. Y., candidate for Patrolman, for a special mental examination, had been referred, presented for the consideration of the Commission a report of the Chief Examiner in relation to the same to the effect that the case seemed to be covered by Rule VII., paragraph II, etc. The appeal was denied.

The President, to whom the application of Paul Stern, of No, 811 Freeman street, The Bronx, for Lay Sanitary Inspector, had been referred, presented the same for consideration by the full Board. The application was rejected under the provisions of Rule VII., paragraph 14.

The President, to whom had been referred the application of Francis Mullen, of No. 183 West Sixty-third street, Manhattan, for Process Server, presented the same for consideration by the full Board. The application was accepted.

The President, to whom had been referred the application of William Posner, of No. 158 East Seventy-ninth street, Manhattan, for Process Server, presented the same for consideration by the full Board. The application was rejected, under the provisions of Rule VII., paragraph 14.

The Commission then considered the matter of construing clause 6 of Rule XII., with reference to the application of the words "in any one year," a question having been raised as to whether the same applied to the current calendar year or to any twelve successive months. The matter was referred to the Secretary for a report.

A communication was presented from the Chief Examiner, dated March 31, suggesting the following weights for the forthcoming examination for Inspector of Foods (Fruit):
