Comptroller would not pass bills of the Telephone Company which included the services of operators; that, in the central office of the Department of Public Charities there was one operator who had been employed through the company since June 15. 1890; that the Board of Estimate and Apportionment had been requested to establish grades of the position of Telephone Operator, but that as yet no action had been taken, and that upon the list certified by the Commission there were only two male operators who were willing to accept appointment at $15 a week. Authority was therefore requested to continue the services of the operator at the central office pending the establishment of a grade by the Board of Estimate and Apportionment. The matter was referred to the Secretary for a report.

A communication was presented from the Secretary of the Board of Trustees of Bellevue and Allied Hospitals, dated December 14, requesting that an open competitive examination for the position of Dietitian be held, and suggesting a number of requirements for the examination. The Secretary was directed to reply and state that the Commission was about to hold an examination for Dietitian, and that the scope of same, as outlined by the Chief Examiner, would practically meet all the requirements specified in their letter.

A letter was presented from the Secretary of the Board of Education, dated December 10, requesting that the classification of non-competitive positions be amended by including therein, under the heading "Positions in the Nautical School, Board of Education." the title "Yeoman." The Secretary was directed to advertise a public hearing on the proposed amendment, in accordance with Rule III.

A letter was presented from Herman K. Endemann, Assistant Engineer, office of the President of the Borough of Queens, dated December 11, transmitting the application of Thomas T. Robinson for promotion from Axeman to Topographical Draughtsman, and stating that the same was to take the place of the application previously filed by Mr. Robinson, which had been "mislaid." On motion, the Secretary was directed to return the application with the statement that an examination for promotion from Axeman to Topographical Draughtsman could only be considered upon the request of the Borough President, and that such an examination, in the event of the same being ordered by the Commission, would have to be open to all the Axemen employed in the Department.

The following emergency appointments were approved in accordance with paragraph 4 of Rule XII.:

The Secretary presented, with a request for instructions, a voucher from the office of the Commissioners of Accounts in favor of John H. Stewart, amounting to $100, for services rendered as an Expert Inspector from October 29 to November 21, 1908. The Secretary was directed to certify the voucher in accordane with paragraph 6 of Rule XII.

A letter was presented from the President of the Borough of Queens, dated December 9, transmitting a supplementary payroll for the salary of John Hunt as Foreman, amounting to $90; Fred Blessenger as Assistant Foreman, amounting to $6, and Thomas J. Kelly as Laborer, amounting to $40, which amounts had been deducted from the weekly payrolls of the Bureau of Highways for the reason that the men had been reassigned to duty without the formal approval of the Civil Service Commission. On motion, the payroll was approved.

The following reports of Departmental Boards of Examiners for positions in the non-competitive class were approved upon the recommendation of the Chief Examiner:

The Nautical School (Board of Education), November 19, December 11.
Department of Public Charities, December 7, December 14.

Brooklyn Disciplinary Training School, December 5.

A letter was presented from Deputy Comptroller McCooey, dated December 11, notifying the Commission of the reassignment of the following named persons as Bookkeepers in that Department in the absence of an eligible list for that position:

Peter M. Oates, John E. McKeever, John A. Bauer, David C. Sexton, William Eggert, Jr., Ellis E. Waring, Bernard J. Looram, Eugene Murphy, L. K. Soper, Moses

S. Silveira, Arthur Fortune, William A. Finn, Edward F. Lacey, George Levison, Charles E. Davenport.

The Secretary stated that the said persons had been appointed provisionally on July 17, 1908, in accordance with paragraph 3 of Rule XII., after having passed the requisite non-competitive examination, and that their services had been dispensed with on November 30. The reassignment was approved and the Secretary was directed to attach a special certificate to the payroll, setting forth the facts in the case.

A letter was presented from the Collector of Assessments and Arrears, Department of Finance, dated December 9, stating that William H. Mulhern, of No. 660 Dean street, Brooklyn, had reported at the time of the certification of his name for appointment as Temporary Clerk from the list of Searcher (September 10, 1908), and stated that in view of the fact that he was employed at the time in the office of the Receiver of Taxes as a Temporary Clerk, he was obliged to decline the temporary appointment proffered him from the list of Searcher. The Secretary stated that the records showed that the Department had merely reported at the time of the certification that Mr. Mulhern had declined temporary appointment from the list of Searcher, and that his name, therefore, had not been certified again for temporary work. On motion, the Secretary was directed to restore the candidate to eligibility for temporary employment.

A letter was presented from the Clerk of the Court of Special Sessions, Second Division, dated December 10, requesting that the title of Thomas F. Meagher, Court Attendant, be changed to Assistant Clerk. The Secretary was directed to state that the desired change could only be effected by a promotion examination which would be open to all the Attendants in the employ of the Court.

On motion, the Secretary was directed to proceed with the following non-competitive examinations for promotion to the grades specified, in accordance with the provisions of paragraph 9 of Rule XV., there being less than three persons employed in each grade in the bureaus specified, and the examinations having been requested by the heads of the departments, in accordance with the Commission's resolution of December 2.

The applications of the following named persons for Patrolman, bearing the certificates of non-residents of The City of New York, were accepted:

A letter was presented from Henry W. Herbetz, Corresponding Secretary of the Temporary Clerks' Association, stating that at a regular meeting of that association, held on December 11, he had been instructed to file a protest against the action of the Commission in certifying men from the list of Searcher to perform temporary work in the Bureau for the Collection of Assessments and Arrears of the Department of Finance; also stating that the association had been advised that such action was a violation of the rules, etc., and demanding immediate withdrawal of the certification. The communication was ordered filed.

The Secretary presented for consideration a communication signed by William L. Wilson, Jesse C. Brettell and Edward O'Neill as a committee in behalf of the "old bridge employes who had worked continuously for more than ten years for the Brooklyn Rapid Transit Company and whose positions were abolished at the same time that all other positions on the bridge railroad were abolished," etc. The letter was referred to the Secretary for a report.

The following requests for restoration to the eligible lists indicated were granted: James L. Salmon, No. 63 Irving avenue, Brooklyn, Janitor Engineer and Stationary Engineer. Declined appointment in November on account of illness. (Doctor's certificate.)

James J. Doherty, College Point, Long Island. Searcher (for appointment as Temporary Clerk). Stated that when he declined appointment as Temporary Clerk in the Department of Finance he had a permanent position which he had since lost.

The following requests for restoration to the eligible lists indicated were denied for laches:

Hubert N. Lathrop, Marcy avenue and South Ninth street, Brooklyn, Telephone Operator.

William Wood, No. 300 West Forty-second street, Inspector of Sewer Construction. A letter was presented from John F. Flynn, of No. 354 Hicks street, Brooklyn, stating that he had made an error in giving July 22, 1885, as the date of birth in his application for Patrolman filed November 23, 1908, and that according to the records of the Board of Health he was only 21 years of age. The application was rejected. A letter was presented from Charles Rieth, of No. 178 Franklin street, Manhattan, requesting a special examination for promotion to the grade of Assistant Foreman in the Fire Department on the ground that he had been reinstated in the position of Fireman by an order of the Court, and that he was out of the Department at the time that the general examination for promotion was held. The request was denied for lack of power.

The Commission then considered the application of the Department of Health for an amendment of the classification by including in the non-competitive class the positions of Matron and Hospital Superintendent, which had been laid over at a previous meeting. On motion, the application was denied, and the Secretary was directed to proceed with examinations for promotion to the positions of Matron and Hospital Superintendent in the Board of Health.

On motion of the President the following preamble and resolutions were adopted: Whereas, In the case of Alexander S. Scherr, applicant for the position of Patrolman in the Police Department, who filed an application on October 4, 1907, and whose name was certified for appointment on May 22, 1908, the Municipal Civil Service Commission finds that the handwriting in his written examination is so manifestly different from that in his application paper and in his physical examination sheet as to leave no doubt in their minds that Scherr was personated in the mental examination by one William H. Lake; and

Whereas, Scherr was suspended from duty on October 22, 1908, upon the request of the Civil Service Commission and ordered to show cause before the Commission, at its meeting of October 28, why he should not be dismissed from the Police Department; and

Whereas, The hearing was adjourned until the meeting of November 24, when Scherr appeared before the Commission in pursuance of due service of notice, and refused to be sworn or to make an affidavit that he had passed the mental examination, or that the papers in question had been written by him; now, after due consideration of all the Civil Service records in this case, be it

Resolved, That the said Alexander S. Scherr was guilty of violating subdivision 6 of section 13 of chapter 370 of the Laws of 1899, in that he had another person take the mental examination for Patrolman for him on the 24th day of January, 1908; and be it further

Resolved, That, pursuant to the provisions of paragraph 6 of Rule XI. of the rules of the Municipal Civil Service Commission, the certification of names to the Police Commissioner under date of May 22, 1908, in so far as it relates to the name of Alexander S. Scherr, be and is hereby revoked; and be it further

Resolved, That the Police Commissioner be notified that the Commission will refuse to further certify the payroll of Alexander S. Scherr, and that the Police Commissioner be requested to drop the name of Alexander S. Scherr from the roster as a member of the uniformed force.
