FISH, GAME AND FOREST LAWS OF NEW YORK.

The laws for the protection, preservation and propagation of birds, fish and wild animals in the State of New York were codified and re-enacted by the Legislature in 1892, amended in 1893 and 1894, revised and re-enacted and consolidated with the forest laws in 1895, and further amended in the succeeding years. They constitute chap. 31 of general laws. They are also known as chap. 488 of the laws of 1892, as amended by the Legislature each year since.

A law has been enacted which makes the catching and killing of beaver a misdemeanor, punishable by fine of $50 for each offense.

An important law says that any person owning land which he reserves as private fishing premises, if "hereafter stocked by the State from any of the hatcheries, hatching stations, or by fish furnishers at expense of the State, shall be and remain open to the public to fish therein, same as though the private park law had never existed."

Another law states that "No trout of any kind, salmon trout or land locked salmon shall be taken away from waters of this State to stock a private pond or stream, except that the owner may, upon the written consent of the fisheries, game and forest commission, take such fish from stream of water running through premises owned by him, for purpose of being placed in such private pond.' The law in its application to fresh water also provides for the licensing of nets. If nets are licensed and have a tag on the protectors and foresters can identify owner of a net illegally used, and if the tag is missing the net can be destroyed. The law prohibits the polluting of streams or taking fish by drawing off water or by dynamite, or from a stream to stock a private pond or stream. No fishing through the ice in waters inhabited by trout or salmon.

Game.

(Game must not be transported out of the state.) Deer-Close season, Nov. 16 to Aug. 31, inclusive. Fawns shall not be taken or possessed at any time. Dogs cannot be used in hunting. Not more than two deer may be taken. Venison cannot be possessed or sold from Nov. 21 to Aug. 31. Only one carcass can be transported and must be accompanied by owner; not more than two transported in one year. This does not apply to the head, feet or skin of deer carried separately. Traps, salt licks and other devices, also crusting and yarding, are illegal. Jacking is prohibited until Aug. 15, 1902. On Long Island deer may be taken on the first two Wednesdays and Fridays after the first Tuesday of Nov. Dogs may be used on those days only.

Hares and rabbits-Close season, Dec. 16 to Sep. 1, in counties of Albany, Columbia, Erie, Fulton, Greene, Hamilton, Livingston, Monroe, Orange, Orleans, Schoharie, Steuben, Ulster, Wyoming; in Richmond Co., from Dec. 31 to Nov. 1; in Oneida and Sullivan Cos., from Feb. 15 to Sept. 15. Ferrets cannot be used in counties where there is a close

season.

Squirrels-Close season for black and gray squirrels, Dec. 16 to Aug. 31; in Greene Co., from Dec. 16 to Sept. 30; on Long Island, Jan. 1 to Oct. 31.

Birds.

Partridge (grouse)-Close season, Dec. 16 to Sept. 15; in Greene, Ulster and-Sullivan Cos., Dec. 16 to Sept. 30; on Long Island, Jan. 1 to July 31. No open season in Erie, Genesee, Livingston, Monroe, Niagara, Rensselaer and Wyoming counties prior to 1903. Not more than 36 may be taken by one person in a season. Pheasants-No open season (except in Suffolk County) before 1905. In Suffolk County, close season, Jan. 1 to Oct. 31. Plover-Close season, May 1 to Aug. 31; on Long Island, Jan. 1 to June 30.

Quail Close season, Dec. 16 to Oct. 31. season before 1903, Cattaraugus, Cayuga, Chautauqua, Erie, Genesee, Monroe, Montgomery, Niagara, Richmond, Saratoga and Wyoming counties. On Long Island, Jan. 1 to Oct. 31; on Gardiner's Island, Oct. 15 to Jan. 31.

Robins (and other wild birds)-No open season. Snipe-Close season, May 1 to Aug. 31; on Long Island, Jan. 1 to June 30.

Wild fowl-Close season for brant, ducks, geese, swan, April 30 to Aug. 31. Must not be hunted between one hour after sunset and one hour before

sunrise, and can only be shot with gun fired without rest. In Jefferson Co., close season, Feb. 1 to Aug. 31, or in the night from sunset to sunrise. The use of boats (except ropelled by hand) and of floating devices, is illegal more than 50 feet from shore. On Long Island, close season May 1 to Sept. 30; no hunting between sunset and daylight. Any floating device may be used at any distance from the shore in Long Island Sound and Shinnecock, Gardiner's and Peconic Bays, and except from Sept. 30 to Oct. 19, in Great South Bay, west of Smith's Point. Sail boats are lawful in Long Island Sound, Gardiner's and Peconic Bays. Woodcock-Close season, Dec. 16 to Sept. 15. Not more than 36 may be taken in one season. Close season in Oneida Co., Nov. 16 to Aug. 31; in Ulster and Greene counties, Dec. 16 to Sept. 30; in Clinton, Essex, Warren, Fulton and Hamilton counties. Dec. 16 to Aug. 15; in Richmond Co., Jan. 1 to July 3; on Long Island, Jan. 1 to July 31.

Fish.

Bass (black)-Close season, Jan. 1 to June 15; legal length, 10 inches. Not more than 24 to be taken in one day and not more than 36 by two persons in one boat. Close season, St. Lawrence River and Jefferson Co., Jan. 1 to June 9; in Lake George and Schroon Lake, Dec. 16 to July 31; in Salmon River (in town of Fort Covington, between Canada line and dam of village) and in St. Regis river (in town of Bombay, between Canada line and Mills and Langtry dam), Nov. 15 to May 1. In Orange Lake, no fishing between one hour after sunset and one hour before sunrise. Not more than 12 to be taken by one person in one day in St. Lawrence River and not more than 24 by two persons in one boat. Chautauqua Lake close season, Dec. 1 to June 15; in town of Horicon, Jan. 1 to July 10; on Long Island, between Jan. 1 and May 29. Muscallonge-Close season, Mar. 1 to May 30; St. Lawrence River, Jan. 1 to June 9. They may be speared in Chautauqua Lake Mondays and Thurs days for 5 consecutive weeks beginning first Monday in February.

Forest Law.

All the wild or forest land now owned or hereafter acquired in the counties of St. Lawrence. Franklin, Clinton, Essex. Warren, Washington, Hamilton, Herkimer Oneida, Lewis, Greene, Ulster, Sullivan and Delaware, Fulton and Saratoga constitute the Forest Preserve, and cannot be sold or leased nor the timber disposed of.

The Adirondack Park includes all lands now owner or hereafter acquired by the State within the county of Hamilton; towns of Newcomb, Minerva, Schroon, North Hudson, Keene, North Elba, St. Armand and Wilmington, in Essex County; the towns of Harrietstown, Santa Clara, Altamont, Waverly and Brighton, in Franklin County; the

FISH, GAME AND FOREST LAWS OF NEW YORK-Continued. towns of Webb and Wilmurt, in Herkimer County; | rest any person found upon the forest preserve viothe towns of Hopkinton, Colton, Clifton and Fine, in St. Lawrence County; the towns of Johnsburgh, Stony Creek and Thurman, and the islands in Lake George, in Warren County. Such park shall forever be reserved and maintained for the free use of all the people.

All that part of the river St. Lawrence within the State, with the islands, and such lands along the shore as are now owned by or shall hereafter be acquired by the State, has been constituted an international park, known as the "St. Lawrence reservation."

It is a misdemeanor to cut or carry away any tree, bark or timber on the forest preserve, and In addition the person cutting any timber thereon shall forfeit $10 for every tree cut or carried away by him.

The game protectors may, without warrant, ar

lating any of the laws for the protection of same. Fire wardens, appointed, shall take necessary measures for the extinction of forest fires, and may call on any person in their districts for assistance, and a person refusing may be fined $10. In towns outside of the forest preserve the supervisor is fire warden ex officio, and in the absence of the supervisor and fire warden in any town any justice of the peace may act. Any person who sets fire to, or assists another to set fire to any waste or forest lands belonging to the state or to another person, whereby such forests are injured or endangered; or who suffers any fire upon his own lands to extend beyond limits thereof to the injury of woodlands of another or of State, is guilty of a misdemeanor, punishable by imprisonment not exceeding one year, or fine not to exceed $250, or both, and be liable to the person injured for damages.

In 1871 the city charter was amended, changing the term of office from two to three years; and in 1879 the charter was still further amended, changing the city elections from spring to fall. *The first charter of the consolidated city fixed the term of mayor at four years. The amended charter-passed in 1901-changed the term of mayor from four to two years.

Six hundred million acres. lying west of the Mississippi Valley, extending over the Rocky Mountains, the great desert and into California, and able to maintain a population of 50,000,000, an area larger than the whole of Europe, is at present waste land in the United States.

During the fiscal year ending June 30, 1901, the general United States Land Office disposed of 15,662,796 acres of the public domain. exceeding the year 1900 by 2,108.908 acres; with receipts $4.972, 160, an excess of $592,402 over the previous

year.
