Chap. 283.

AN ACT to make provision for the purchase of books for certain judicial libraries in the first judicial department.

Became a law April 8, 1899, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Out of the balance remaining unexpended of the apof books. propriation and additional appropriations made in the final estimate in the city of New York for the year eighteen hundred and ninety-eight for the payment of clerks, deputy clerks, employees, et cetera, for the supreme court in the first judicial department, the comptroller of the city of New York is hereby authorized and directed to pay as hereinafter provided for the purchase of books for the library of the appellate division of the supreme court, and the library of the supreme court in said department, such amount or amounts, not exceeding in the aggregate the amount of said appropriations, remaining unexpended, as shall from time to time. be certified by the presiding justice of said appellate division to be necessary for the purposes aforesaid.

Payment of same.

§ 2. The amount hereinbefore appropriated for the purchase of said books shall be paid out by the comptroller of the city of New York from time to time, and at any times hereafter, upon vouchers certified by the said presiding justice of said appellate division. § 3. This act shall take effect immediately.

AN ACT making an appropriation for the Craig Colony for

epileptics.

Section 1. The following sums are hereby appropriated to the tion for uses and purposes of the Craig Colony for epileptics from any moneys in the treasury not otherwise appropriated: For dormitories, sixty thousand dollars; furnishing, five thousand dollars; water and sewerage, seven thousand, eight hundred dollars; cold storage warehouse and bakery combined, eight thousand, one hundred dollars; industries, including wing to present building, five thousand dollars; extension to power house including two one hundred horse power boilers, four thousand five hundred dollars; two employees' cottages, one thousand eight hundred dollars; grading, roads, walks and planting, two thousand, five hundred dollars; for general repairs and improvements including frame dairy building, purchase of Dansville and Mount Morris railroad switch bed, piling Kishaqua creek to protect lowlands against flood water, silo, sheds for cattle, fencing, farm stock and implements, and hot-house ten thousand, three hundred dollars.

Powers of board of supervisors to issue subpœnaes.

Chap. 285.

AN ACT to authorize the board of supervisors in any county where proceedings have been instituted under the provisions of chapter four hundred and ninety-three of the laws of eighteen hundred and ninety-two, entitled "An act to provide for the construction of highways and bridges upon highways running through two or more towns of the same county," to investigate the affairs and conduct of commissioners appointed under said act.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The board of supervisors in any county of this state where commissioners have been appointed by the supreme court, under and pursuant to the provisions of chapter four hun dred and ninety-three of the laws of eighteen hundred and ninety. two, entitled "An act to provide for the construction of highways and bridges upon highways running through two or more towns of the same county," is hereby empowered in such manner as it shall direct to examine and inquire into the affairs and conduct of any such commissioners in the performance of their duties as such commissioners, and any such board of supervisors shall have like power to inquire into and examine as to the disposition or expenditure of any bonds or moneys that may have come into the hands, or under the control of such commissioners, whether the same shall have been delivered to said commissioners by or under the direction of any such board of supervisors, or by the supervisor or town board of any town within such county.

§ 2. For the purpose of giving effect to the provisions of this act, the board of supervisors of any county in which such commissioners have been appointed and whose conduct such board of supervisors shall determine by resolution to investigate, may, under the hand of its chairman or the chairman of its committee duly authorized to conduct such investigation, subpoena any person for examination as provided in section one of this act and Failure to any person so subpoenaed who fails to obey said subpoena or who refuses without reasonable cause to be examined or to answer a legal or pertinent question or to produce a book or

§ 3. If any such commissioner requires the attendance of any person for examination, in his own behalf, such person shall be subpoenaed, and his attendance required, in the same manner as provided by section two of this act, for the subpoena and attendance of any person for examination on the part of such board of supervisors.

§ 4. This act shall take effect immediately.

AN ACT to amend chapter nine hundred and forty-one of the laws of eighteen hundred and sixty-seven, entitled "An act to amend and consolidate the several acts relating to the charter of the village of Churchville, in the county of Monroe," in relation to the assessment of taxes.

Section 1. Section one of title two of chapter nine hundred and g forty-one of the laws of eighteen hundred and sixty-seven, entitled amended. "An act to amend and consolidate the several acts relating to the charter of the village of Churchville, in the county of Monroe," as amended by chapter three hundred and five of the laws of eighteen hundred and ninety-six, is hereby amended to read as follows:

§ 1. The officers of the village shall be five trustees; one of whom Village shall be president of the board of trustees; one treasurer, one police constable, all of whom shall be elected by ballot by the electors of said village, and hold their offices respectively for one year, and until their successors shall be duly qualified, excepting only the trustees of said village, who, at the Arst election, shall be elected for the respective periods of one,

two, three, four and five years, the persons so elected to determine their respective term of office by lot; and one trustee, to be elected Clerk and annually thereafter, to hold his term of office for five years. There treasurer shall also be one clerk, who shall be appointed by the board of trustees, to serve during the pleasure of the said board. There shall also be one assistant treasurer, who shall be appointed by the treasurer to serve during the pleasure of the treasurer; whose duties shall be to collect taxes and assessments, under the supervision and direction of the treasurer, and whose fees and com pensation as such assistant treasurer shall be the same as now provided by law for similar services rendered by the police constable.

§ 2. Section twelve of title two of said act is hereby amended to read as follows:

§ 12. The board of trustees of such village shall, after the annual election and before the first Tuesday of May of each year, prepare an assessment roll by copying from the last assessment roll of the town of Riga, so far as practicable, a description of all real estate within the village, and the value thereof as the same appears thereon; also of all personal property and the value thereof, assessed on such town roll to residents of the village, or the corporations taxable therefor therein, together with the names of the persons or corporations, respectively, to which such real or personal property is or should be assessed. Such board shall also enter on such roll the names of all persons liable to a poll tax. Where the valuation of taxable property cannot be ascertained from the last assessment roll of the town, or where the value of such property shall have increased or diminished since the last assessment roll of the town, or an error, mistake or omission on the part of the town assessors shall have been made in the description or valuation of taxable property real or personal, such board shall ascertain the true value of the property to be taxed Notice of from the best evidence available. The clerk shall, at least one hearing of week before the first Tuesday in May in each year, cause a notice to be posted in at least five conspicuous public places in the village, that on such first Tuesday in May at a specified place and during four consecutive hours to be named, such board of trustees will hear and determine complaints in relation to such assessment roll, but such trustees shall not hear any complaint as to a valuation which has not been changed.
