Statement by Chief Judge William M. Drennen on the Supplemental
Appropriation Request for the Fiscal Year 1970

Mr. Chairman and Members of this Committee:

The purpose of this statement is to present and explain the supplemental appropriation request for the Tax Court of the United States for the Fiscal Year 1970.

This supplemental request is in the amount of $65,000 and it is required to pay a Judge and his staff for 9 months of the current year. The funds for this purpose were lapsed based on the assumption that there would be a further delay for the fiscal year in nominating another Judge for this vacancy. However, the President nominated and the Senate confirmed Mr. William H. Quealy to be a Judge of the Tax Court and he entered on duty on October 1, 1969. The Court now has its full complement of 16 Judges.

I wish to assure the Committee that the supplemental request as submitted is urgently needed by the Court to meet its financial requirements for 1970.

JUSTIFICATION FOR SUPPLEMENTAL APPROPRIATION

On September 19, 1969, the Senate confirmed the President's nomination of Mr. William H. Quealy to be a Judge of the Tax Court of the United States. Judge Quealy will enter on duty on October 1, 1969. This supplemental request in the amount of $65,000 is to provide funding for the salaries of the Judge and his staff for 9 months of the fiscal year 1970. The funds initially budgeted for this purpose were lapsed entirely from the Court's currently approved budget as the judgement was made that there would be a longer delay in nominating another Judge.

This supplemental funding request covers the 9 remaining months of fiscal year 1970, and the following computations are arrived at on this basis:

needed for obligation and expenditure beginning October 1, 1969.

*On assumption that full staff will not be employed by October 1, 1969.

Obligations for the fiscal year 1970 are as follows:

1/4th quarter apportionment on deficiency basis to provide funds

for pay increase authorized by Public Law No. 90-206 and

salaries for Judge Quealy and his staff from October 1, 1969.
