Transfer of Names from One Eligible List to Another
Disapproved

Communication from Ben F. Fisher, New York City, December 2d, was read, requesting that the eligible list for the position of chief parole officer and assistant parole agent, State institutions, established December 31, 1910, be considered an appropriate list for the position of investigator, automobile bureau, office of the Secretary of State, and that names from said list be transferred to the new list for the latter position when established. On motion the application of Mr. Fisher was denied. (December 11, 1912.)

Promotion to Deputy Clerk, Court of General Sessions

A letter from Edward R. Carroll, Clerk, Court of General Sessions, New York City, under date of December 1st, regarding the appointment of Samuel F. Spellman from the promotion list for deputy clerk, to take effect January 1, 1913, salary $3000 per annum, was read. On motion the promotion was accepted, notwithstanding the fact that the term of eligibility of the list expired December 10th, the appointment having been made prior to that date.

Examination for Superintendent of State Industrial Farm Colony Open to Non-Residents

Communications from Superintendents of the Poor Cash, Monroe county; Dodge, Chautauqua county: Tolley, Greene county; and Hollis, Ontario county, protesting against the opening to non-residents of the examination for the position of Superintendent of State Industrial Farm Colony, were submitted. On motion the Secretary was directed to advise each of the Superintendents that the Commission feels that the position is one of such

importance as to make it advisable to open the competition to non-residents, and therefore believes that the published announce ment in this connection should not be withdrawn.

Transfer of Assistant Special Deputy Clerk to Special Deputy Clerk, Supreme Court, Appellate Division, First Department

A communication from Presiding Justice Ingraham, Supreme Court, Appellate Division, First Department, dated December 17, 1912, relative to the transfer or assignment of an assistant special deputy clerk to the position of special deputy clerk, was read. It appearing that there is no change in salary involved, and that the assistant special deputy clerks perform duties which are essentially similar to those performed by the special deputy clerks, the Commission rules that in view of the statements contained in the letter of Justice Ingraham, which are in a sense a judicial opinion, the change did not constitute a promo

tion.

Promotion Examination for Special Agent, Department of Public Works

The Secretary submitted letters from Superintendent of Public Works Peck under dates of December 13th and 17th, relative to promotion of John C. Leslie, canal collector's clerk, $1200 per annum, to special agent, $1500 per annum. It was the opinion of the Commission that a promotion examination, open to other persons in the Department of Public Works, was required by the rules and the Chief Examiner was directed to arrange the necessary examination upon the request of the Superintendent. Appointment of Chief Record Clerk, New York County

Register's Office

Communication from Register Grifenhagen, New York county, December 19, 1912, relative to the transfer of Abraham Spies, now chief clerk, Department of Preservation of Public Records, salary $1800, to the position of chief record clerk, salary $2100 per annum, was considered. It appearing that Mr. Spies was

appointed to his present position from the eligible list for the position of chief record clerk, upon which list his name was No. 2 at the time it was established, his appointment to the position of chief record clerk at this time, was, on motion, approved. (December 31, 1912.)

Certification of Accounts for Services of Persons Employed in Maintenance and Repair Bureau, Department of Highways, Required

The Secretary submitted communication of Secretary Dillon, Department of Highways, December 14th, relative to the appointment of Miss Amy Clough, stenographer in the Utica office of the department. It was the opinion of the Commission that the appointment of Miss Clough was properly made, as the negotiations therefor took place prior to the expiration of the list on July 18, 1912. The Commission considered, however, that the Highway Department improperly held that because of payment of salary of Miss Clough for the period from July 19th to December 1, 1912, by county draft through the Maintenance and Repair Department, her accounts for salary were not subject to approval by the State Civil Service Commission. The Commission decided that such accounts should have been certified monthly on payroll or by voucher, and it was directed that upon submission of such accounts for certification, and the approval thereof, the name of Miss Clough be entered as a regular appointee in the Highway Department, effective July 19, 1912, salary $60 per month.

List of Bookkeepers to be Certified by Judicial Districts

Communication from Superintendent Macy, Kings Park State Hospital, requesting certification of bookkeepers from the general list instead of from the list for the second judicial district, was submitted. On motion the Secretary was directed to advise Dr. Macy that the Commission did not feel justified in granting his application, as there appears to have been no precedent for such a ruling and the list of bookkeepers for the second district contains the names of a number of qualified applicants.
