SIR: I herewith return approved, draft of proposed circular governing applications for right of way over the public lands for canals, ditches, and reservoirs, granted by the act of March 3, 1891 (26 Stat., 1095).

I have changed said circular so as to provide for the filing of maps partly or wholly over unsurveyed lands, but have limited the approval of such maps to the portion traversing surveyed lands, and have also overruled that portion of the old circular which held that "this act does not contemplate the appropriation, for reservoir purposes, of natural lakes that are already the source of a water supply; nor the damming of rivers so that the adjacent country is overflowed." Many minor changes have been made which will appear on comparison, but they do not involve any principle, and therefore need not be set forth in detail.
