SEC. 25. That in the event of an unexpended balance received from the sale of such bonds, the Town Council may invest the same in interest bearing securities or place the same out at interest upon good and sufficient security as it may deem advisable.

SEC. 26. That the adverse result of an election to determine the question of the issue of bonds for any one or more of the purposes mentioned in this act shall not debar the then existing or any subsequent Town Council from resubmitting or again submitting the question of issue of bonds to the legal voters of the town after the lapse of one year. SEC. 27. That the Town Council shall have power to levy annually such special tax on the taxable property within the corporate limits of the town as may be necessary to provide funds for the payment of said bonds at maturity and the interest coupons thereof; Provided, Such special tax shall not exceed one-half of one per cent. on the dollar. The council shall have power to provide, by ordinance, for the custody and investment of such tax.

SEC. 28. That the first election of officers under this act shall be held by the present officers of the town of Milton in accordance with the present ordinances of said town and the Election of general laws of the State of Florida, in so far as they apply to municipal elections, on the fourth Tuesday in September, A. D. 1897, and annually thereafter on said day. The persons then elected as such officers shall be sworn into office on the second Tuesday in October following, when their terms of office shall begin.

SEC. 29. SEC. 30. That there shall be a Marshal, who shall be exofficio Tax Collector, who shall serve for one year and until his successor is elected and qualified. He shall give such bond as the council may by ordinance prescribe, and shall receive such compensation as is provided by ordinance, which shall not be changed during his term of office.

SEC. 31. That it shall be the duty of the Marshal to attend all regular and special meetings of the Town Council; Duty of to aid in the enforcement of order under direction of the presiding officer; to execute the commands of the council from

time to time, as well as of the Mayor in the line of his duty, and to execute all processes issued by the authority thereof; to attend the Mayor's court during its sittings, and to execute its commands; to aid in the enforcement of order therein under the direction of the Mayor, and to perform such other duties as may be appropriate to his office under the provisions of law or be required by ordinance. He shall have control of the police force, subject to the commands of the Town Council, and shall have police powers of arrest.

SEC. 32. That the Marshal shall have power and authority to immediately arrest, with or without warrant, and take into custody any person or persons who shall commit, threaten or attempt to commit, in his presence, or within his view, any offense prohibited by the ordinances of the town; and he shall, without unnecessary delay upon making such arrest, convey the offender or offenders before the Mayor to be dealt with according to law.

SEC. 33. That the Marshal and members of the police force, in addition to the powers incident to their office and as herein designated, shall possess common law and statutory authority of constables except for the service of civil process.

SEC. 34. That it shall be the duty of the Tax Collector to collect all taxes on real and personal property in the town, according to the assessment roll delivered to him by the Assessor of Taxes of the town, as required by ordinance; to collect all licenses on trade and occupations provided for in 'this charter and the ordinances of the town; receive all funds, giving receipt for the same; he shall make weekly payments to the Treasurer of all funds coming into his hands, and take the Treasurer's receipt therefor; he shall make a monthly report to the Town Council, or oftener if required, of all receipts and collections made by him, and payments to the Treasurer. The Collector shall perform all acts required of him in the collection of taxes and licenses as stipulated by ordinances of the town and shall give such bond as the Town Council may determine.

SEC. 35. There shall be one office of Clerk and Treasurer (who may, by ordinance, also be Tax Assessor), and said offi cer shall serve for one year and until his successor is elected and qualified; he shall be elected at each general election, receive such compensation and give such bond as the Town Council may require; his compensation shall not be reduced during his term of office; he shall report monthly to the council all payments made to and by him, and all balances of public funds; to receive all moneys due the town for taxes, licenses and other sources; attend all meetings of the Town Council; he shall keep and enter on minutes a record of all

official acts of the council, and enter into books to be kept for that purpose all ordinances and resolutions passed by the council; and to perform such other duties as the Town Council may require usually pertaining to his office.

SEC. 36. That there shall be a Tax Assessor, who shall be elected annually at the general election (except when by ordinance the Clerk is required to perform the duties of Tax Tax Assessor. Assessor), who shall serve for one year and until his succesor is elected and qualified. He shall receive such compensation and give such bond as the Town Council may require. It shall be the duty of said officer to make an annual assessment of all the property, both real and personal, in the town of Milton for taxation, but the valuation thereof shall not exceed the valuation thereof by the State for taxation, and such assessment shall include the property of railroad and telegraph companies in harmony with the laws of the State of Florida. He shall perform such other duties pertaining to his office as the Town Council may by ordinance require.

SEC. 37. That all property, real and personal, in the town of Milton, not expressly exempted by the laws of the State of Property subFlorida, shall be subject to taxation in the manner provided in ject to taxation this charter and by the ordinance of the town of Milton. SEC. 38. That between the first day of January and the first Monday in August in each year, the Tax Assessor shall ascertain by diligent inquiry all taxable property, real and personal, within the limits of the town, and Assessment the owner thereof on the first day of January, and shall make property. out duplicate assessment rolls of all such taxable property. The assessment of personal property shall be made separate from real estate. The assessment rolls shall be prepared in conformity with the law governing State and county assessments, so far as the same may apply. And in all respects wherein the duties of the Tax Assessor are not specifically prescribed herein, he shall conform substantially to the regulations and requirements of the laws of the State in regard to assessment of taxes.

SEC. 39. The Tax Asssessor shall complete the assessment rolls of the town on or before the second Tuesday in August in every year, on which day such officer shall meet with the Town Council for the purpose of reviewing and equalizing the assessment, and they may continue in session for that purpose from day to day as long as shall be necessary, and the Town

Council may review the same, hear complaints and correct inequalities in such valuation, and for that purpose may raise or lower the value fixed by the Assessor, keeping within the valuation by the State for taxation.

SEC. 40. That the Town Council shall thereupon on the second Tuesday in January in every year meet and determine the amount to be raised by taxation for municipal purposes, and shall fix and determine the rate of taxation for the current year, as is herein provided. The council is hereby authorized and empowered to levy annually such taxes as are authorized by the general laws of the State of Florida, and in addition thereto the Town Council may levy an annual tax of not exceeding two and one-half mills on the dollar, upon all the taxable real and personal property, for general municipal purposes.

SEC. 41. That the territory contained within the corporate limits of the town of Milton is hereby declared to be and the same is hereby constituted an independent road district.

SEC. 42. That every able bodied male person over the age of eighteen years and under age of forty-five years, resident in the town of Milton for thirty days, shall be subject and liable to work on the streets and bridges of the town for not more than eight days in each year, and the Town Council shall have the power by ordinance to regulate such service and to impose penalties for its non-performance; Provided, That any such person so subject to street duty may perform such service by an able bodied substitute over the age of eighteen years, or in lieu thereof may pay the Marshal of said town the sum of fifty cents for each day he was required to work, taking his receipt therefor; Provided further, That all maimed or crippled persons who shall procure a certificate of such disability from some practicing physician, persons of unsound mind, ministers of the gospel in charge of a church, shall be exempt from street duty under this law.

SEC. 43. That one-half of the amount realized from the special road and bridge tax levied on property within the town of Milton by the County Commissioners of Santa Rosa and bridge tax county shall be turned over annually to the municipal author

SEC. 47. SEC. 48. That all ordinances and parts of ordinances now in force in the town of Milton which are not in conflict with the provisions of this act, or with the Constitution and laws of the State of Florida, shall be and remain in full force and until repealed. effect until repealed by the Town Council or their successors; and all laws now in force or that may hereafter be enacted for the government of cities and towns, except in so far as they conflict with the provisions of this act, shall apply to the town of Milton and the officers thereof.

SEC. 49. That all assessments, levies and collections of taxes heretofore done and performed by the incorporation of the town of Milton are hereby legalized and declared valid and of full force, virtue and effect and binding in law and equity.

SEC. 50. That the Town Council may by ordinance exempt from municipal taxes for a period of five years business enterprises, such as hotels of not less than twenty-five rooms, manufactories employing not less than ten laborers, and such others as will have a tendency especially to benefit the town; Provided, however, That no business now in operation shall be exempt.
