THE CIVIL SERVICE LAW.

AN AOT in relation to the civil service, constituting chapter twenty-three of the general laws.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Short title.- This chapter shall be known

2 as the civil service law.

§ 2. Civil service commission. There shall continue to 2 be a state civil service commission consisting of three 3 members, not more than two of whom shall belong to 4 the same political party, who shall be appointed by the 5 governor, by and with the advice and consent of the 6 senate. A majority of such members shall constitute a 7 quorum, but a less number may adjourn from day to 8 day.

Each commissioner shall receive an annual salary of 10 two thousand dollars, together with necessary traveling 11 expenses incurred in the discharge of his official duties, 12 and shall hold no other official position under the state 13 government.

§ 3. Powers and duties.- The commission shall keep a 2 record of its own proceedings and, subject to the rules 3 made by the governor, make regulations for and control 4 all examinations, and through its members or examiners 5 supervise and preserve the records thereof.

6 It shall inquire into the methods of appointment, 7 removal, terms of service, duties, compensation and 8 number of all clerks, employes and subordinate officers 9 in the public service of the state or of cities or counties 10 therein having a population exceeding fifty thousand 11 inhabitants except elective officers and those appointed 12 by the governor or mayor of a city; and whether the 13 action of political parties or the public acts of official 14 servants are affected, and if so, to what extent by the 15 present method of appointment, tenure of office, removals 16 and compensation, and whether the public interest would 17 or would not be advanced by prescribing competitive 18 tests or standards of appointments for such subordinate 19 public servants, and if so, the nature and extent thereof; 20 and whether any abuses exist in connection with the 21 existing practices in regard to such appointments, ten22 ures, compensation or removals, which should be 23 reformed or abated by legislation or otherwise.
