1 Agriculture for administration as part of, and in accordance 2 with laws, rules, and regulations applicable to, the national 3 forest system. Such transfer shall not result in the reduction 4 in the percentage of in-lieu payments receivable by State and 5 local governments. Lands acquired by exchange under this 6 section or section 301 (c) which are within the boundaries of 7 national park, wildlife refuge, wild and scenic rivers, trails, 8 or any other system established by Act of Congress may be 9 transferred to the appropriate agency head for administra10 tion as part of, and in accordance with the laws, rules, and 11 regulations applicable to, such system.

(e) Lands and interests in lands acquired pursuant to 13 this section or section 301 (c) shall, upon acceptance of title, 14 become national resource lands, and, for the administration 15 of public land laws not repealed by this Act, shall become 16 public lands. If such acquired lands or interests in lands are located within the exterior boundaries of a grazing dis18 trict established pursuant to section 1 of the Taylor Grazing 19 Act (48 Stat. 1269), as amended, they shall become a part

24 CONTRIBUTIONS.-(a) The Secretary may conduct investi

25 gations, studies, and experiments, on his own initiative or in

1 cooperation with others, involving the management, pro

2 tection, development, acquisition, and conveying of the 3 national resource lands.

(b) The Secretary may enter into contracts or coopera5 tive agreements involving the management, protection, de

6 velopment, acquisition, and conveying of the national resource lands.

8 (c) The Secretary may accept contributions or dona9 tions of money, services, and property, real, personal, or 10 mixed, for the management, protection, development, acqui11 sition, and conveying of the national resource lands, including 12 the acquisition of rights-of-way for such purposes. He may 13 accept contributions for cadastral surveying performed 14 on federally controlled or intermingled lands. Moneys 15 received hereunder shall be credited to a separate account in 16 the Treasury and are hereby appropriated and made available 17 until expended, as the Secretary may direct, for payment of 18 expenses incident to the function toward the administration 19 of which the contributions were made and for refunds to de20 positors of amounts contributed by them in specific instances 21 where contributions are in excess of their share of the cost. SEC. 302. SERVICE CHARGES, REIMBURSEMENT PAY23 MENTS, AND EXCESS PAYMENTS.-(a) Notwithstanding 24 any other provision of law, the Secretary may establish fil25 ing fees, service fees and charges, and commissions with

1 respect to applications and other documents relating to na2 tional resource lands and may change and abolish such fees, 3 charges, and commissions.

4 (b) The Secretary is authorized to require a deposit of 5 any payments intended to reimburse the United States for 6 extraordinary costs with respect to applications and other 7 documents relating to national resource lands. The moneys 8 received for extraordinary costs under this subsection 9 shall be deposited with the Treasury in a special account and 10 are hereby appropriated and made available until expended. 11 As used in this subsection, "extraordinary costs" include but are not limited to the costs of special studies; environmental 13 impact statements; monitoring construction, operation, main14 tenance, and termination of any authorized facility; or other 15 special activities.

16 (c) In any case where it shall appear to the satisfaction 17 of the Secretary that any person has made a payment under 18 any statute relating to the sale, lease, use, or other disposi19 tion of the national resource lands which is not required or is 20 in excess of the amount required by applicable law and the 21 regulations issued by the Secretary, the Secretary, upon ap22 plication or otherwise, may cause a refund to be made from 23 applicable funds.

SEC. 303. WORKING CAPITAL FUND.-(a) There is

25 hereby established a working capital fund for the manage

ment of national resource lands. This fund shall be available 2 without fiscal year limitation for expenses necessary for fur3 nishing, in accordance with the Federal Property and Admin4 istrative Services Act of 1949 (63 Stat. 377), as amended, 5 and regulations promulgated thereunder, supplies and equip6 ment services in support of Bureau of Land Management 7 programs, including but not limited to, the purchase or con8 struction of storage facilities, equipment yards, and related 9 improvements and the purchase, lease, or rent of motor ve10 hicles, aircraft, heavy equipment, and fire control and other 11 resource management equipment within the limitations set 12 forth in appropriations made to the Bureau of Land 13 Management.

14 (b) The initial capital of the fund shall consist of ap15 propriations made for that purpose together with the fair and 16 reasonable value at the fund's inception of the inventories, 17 equipment, receivables, and other assets, less the liabilities, 18 transferred to the fund. The Secretary is authorized to make 19 such subsequent transfers to the fund as he deems appropri20 ate in connection with the functions to be carried on through 21 the fund.

(c) The fund shall be credited with payments from 23 appropriations and funds of the Bureau of Land Manage24 ment, other agencies of the Department of the Interior,

other Federal agencies, and other sources, as authorized by

2 law, at rates approximately equal to the cost of furnishing 3 the facilities, supplies, equipment, and services (including 4 depreciation and accrued annual leave). Such payments may 5 be made in advance in connection with firm orders, or by 6 way way of reimbursement.

(d) There is hereby authorized to be appropriated not

to exceed $3,000,000 as initial capital of the working capital 9 fund.

SEC. 304. DEPOSITS AND FORFEITURES.-(a) Any 11 moneys received by the United States as a result of the for12 feiture of a bond or other security by a resource developer or 13 purchaser or permittee who does not fulfill the requirements 14 of his contract or permit or does not comply with the regula15 tions of the Secretary, or as a result of a compromise or 16 settlement of any claim whether sounding in tort or in con17 tract involving present or potential damage to national resource lands shall be credited to a separate account in the 19 Treasury and are hereby appropriated and made available, 20 until expended as the Secretary may direct, to cover the cost to the United States of any improvement, protection, or re22 habilitation work on the national resource lands which has

23 been rendered necessary by the action which has led to the

24 forfeiture, compromise, or settlement.

(b) The Secretary may require a user or users of roads,
