AMENDMENTS TO STATE CIVIL SERVICE RULES

Rule IV, section 5

Resolved, That, subject to the approval of the Governor, the fifth paragraph of rule IV of the state civil service rules be and hereby is amended by adding thereto the following: "Provided, that such requirement as to residence may be specially suspended by the Commission as to any position requiring high professional, scientific or technical qualifications, or in cases where through low compensation for services such requirement is disadvantageous to the public interests, but all such cases, whether of individuals or groups, with the reasons therefor, shall be reported to the legislature", so that said paragraph shall read as follows:

"5. Appointments to positions in the service of any county to which the provisions of these rules apply shall be made from residents of such county; provided, that such requirement as to residence may be specially suspended by the Commission as to any position requiring high professional, scientific or technical qualifications, or in cases where through low compensation for services such requirement is disadvantageous to the public interests, but all such cases, whether of individuals or groups, with the reasons therefor, shall be reported to the legislature."

Rule XV, section 5

Resolved, That, subject to the approval of the Governor, civil service rule XV, paragraph 5, be and hereby is amended by inserting therein the words, "or has served at least three years in the position from which he desires transfer", so that said paragraph shall read as follows:

"5. A transfer from a position in the competitive class of the civil service of the state to a similar position in the same class in any of the cities or civil divisions thereof, and vice versa, may be allowed in the discretion of the Commission only when the

person to be transferred obtained his appointment by virtue of an open competitive examination conducted by or under the direction of the State Civil Service Commission, or has served at least three years in the position from which he desires transfer, and when the proposed transfer is in accord with sections 1, 2 and 3 of this rule."

Rule V. Local health officers

Resolved, That, subject to the approval of the Governor, the paragraph of civil service rule V, which includes in the exempt class local health officers whose compensation does not exceed three hundred dollars per annum, be and hereby is amended by striking from the clause which provides that appointees shall be practicing physicians of not less than five years' reputable standing the word "five" and inserting in place thereof the word "two", so that said paragraph shall read as follows:

"Local health officers whose compensation does not exceed three hundred dollars per annum, provided that persons appointed shall be practicing physicians of not less than two years' reputable standing and whose nomination or selection is approved by the state commissioner of health and so certified to the Commission." (Adopted July 9, 1903. Approved by the Governor August 12, 1903.)

Rule VIII, sections 3, 4 and 10

Resolved, That, subject to the approval of the Governor, civil service rule VIII, sections 3, 4 and 10, be amended so as to read as follows:

"3. From the persons whose names are so certified the officer shall make a selection to fill the vacancy or vacancies, subject, however, to the provisions of the constitution giving preference in appointment to veterans. Whenever the appointing officer who shall have made a requisition to fill a certain number of vacancies shall appoint a number smaller than that of the vacancies named by him, he shall not make selection from the whole number certified to him but only from that number of names standing highest upon the list that would have been certified to
