GENERAL ORDERS,

No. 95.

WAR DEPARTMENT, WASHINGTON, July 7, 1911.

The board of officers established at headquarters, Philippines Division, Manila, Philippine Islands, by paragraph I of General Orders, No. 255, December 30, 1907, and paragraph II of General Orders, No. 216, November 28, 1910, War Department, will hereafter be known as the Defense Board, Philippine Islands, and will consist of

The chief of staff, Philippines Division.

The officer in charge of defensive works, Philippines Division.

The officer in charge of the military information division, Philippines Division.

The chief engineer officer, Philippines Division.
The chief ordnance officer, Philippines Division.
The chief signal officer, Philippines Division.

The coast defense officer, Philippines Division.

The constructing quartermaster, Corregidor, Philippine Islands.

Three officers of the line of the Army, to be designated by the commanding general, Philippines Division.

A recorder, to be appointed by the commanding general, Philippines Division.

It shall be the duty of the board to take into consideration all questions of defense and the posts pertaining thereto for the Philippine Islands and to submit reports thereon for the information of the Secretary of War. These reports will be forwarded through the commanding general, Philippines Division, who will indorse thereon his views in the matter.

The board will be governed by such instructions as it may receive from the Secretary of War and the division commander.

Such journeys as the members of the board may be required to make in transacting the business of the board are necessary in the military service.

I. Before a general court-martial which convened at Fort Sam Houston, Texas, pursuant to Special Orders, No. 95, April 27, 1911, Department of Texas, and of which Colonel JOSEPH H. DORST, Third Cavalry, was president, and Captain JAMES J. MAYES, Tenth Infantry, was judge advocate, was arraigned and tried

Second Lieutenant James P. Wayland, Ninth Cavalry.

CHARGE I." Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War."

Specification 1.-" In that 2d Lieutenant James P. Wayland, 9th Cavalry, did on or about November 24th, 1910, transfer and assign, for value received, his pay voucher for the month of November, 1910, to one C. D. Houck, of Cheyenne, Wyoming, by endorsement signed on the back thereof by him, the said Lieutenant Wayland, as follows:

"Transferred this 30th day of November, 1910, to C. D.

Houck.

"JAS. P. WAYLAND,

2d Lieut. 9th Cavalry.'

"and did on or about the 30th day of November, 1910, cause to be presented to Major M. K. Barrol, Paymaster, U. S. Army, another pay voucher for the said month of November, 1910, receiving therefor, from the said Major Barrol his pay in full for the month of November, 1910, amounting to one hundred and seventy-two dollars and fifty cents ($172.50), and did certify on said voucher, that the foregoing statement is correct.' This at or near Cheyenne, Wyoming, on or about the dates above specified."

Specification 2.— In that 2d Lieutenant James P. Wayland, 9th Cavalry, did on or about November 24th, 1910, transfer and assign, for value received, his pay voucher for the month of January, 1911, to one C. D. Houck of Cheyenne, Wyoming, by endorsement signed on the back thereof, by him, the said Lieutenant Wayland, as follows:

"Transferred this 30th day of January, 1911, to C. D.

Houck.

"JAS. P. WAYLAND,

"and did on or about the 31st day of January, 1911, cause to be presented to Major M. K. Barrol, Paymaster, U. S. Army, another pay voucher for the said month of January, 1911, receiving therefor from the said Major Barrol, his pay in full for the said month of January, 1911, amounting to one hundred and seventy-two dollars and fifty cents ($172.50) and did certify on the said voucher that the foregoing statement is correct.' This at or near Cheyenne, Wyoming, on or about the dates above specified."

CHARGE II. Conduct to the prejudice of good order and military descipline in violation of the 62d Article of War." Specification 1.-" In that 2d Lieutenant James P. Wayland, 9th Cavalry, did on or about November 24th, 1910, and before his pay voucher for November, 1910, was actually due, transfer and assign, for the sum of one hundred and seventy dollars ($170.00) more or less, the said pay voucher for the month of November, 1910, to one C. D. Houck of Cheyenne, Wyoming, by endorsement signed on the back thereof by him, the said Lieutenant Wayland, as follows:

"Transferred this 30th day of November, 1910, to C. D.

Houck.

"JAS. P. WAYLAND,

"2d Lieut. 9th Cavalry.'

"This at or near Cheyenne, Wyoming, on or about the dates above specified."

Specification 2.-"In that 2d Lieutenant James P. Wayland, 9th Cavalry, did on or about November 24th, 1910, and before his pay voucher for January, 1911, was actually due, transfer and assign, for the sum of one hundred and seventy dollars ($170.00) more or less the said pay voucher for January, 1911, to one C. D. Houck of Cheyenne, Wyoming, by endorsement signed on the back thereof by him, the said Lieutenant Wayland, as follows:

"Transferred this 30th day of January, 1911, to C. D.

Houck.

"JAS. P. WAYLAND,
"2d Lieut. 9th Cavalry.'

"This at or near Cheyenne, Wyoming, on or about the dates above specified."

To which charges and specifications the accused pleaded as follows: To the first and second specifications, first charge, and to the first charge, "Not guilty."
