RULES FOR THE CLASSIFIED SERVICE OF THE CITY

OF LACKAWANNA

Pursuant to the statutes of the State of New York providing for examinations to ascertain and determine the merit and fitness

of

persons seeking to enter the civil service of the State of New York and the cities thereof, and the regulation of the same, we, Miles S. Wasson, Peter F. Smith, James F. Wardner, duly appointed by the Mayor of the city of Lackawanna to prescribe, amend and enforce rules for the classification of the offices, places and employments in the classified service of the city of Lackawanna, and for the appointments and promotions therein and examinations therefor, do hereby prescribe the following rules for the classification of the offices, places and employments in said classified service, and the promotions therein and examinations therefor, and for the registration and selection of laborers for employment in the said service, which having been approved by the Mayor, shall take effect from the date of their approval by the State Civil Service Commission.

Application of Rules - Rule I

These rules shall apply to all positions in the public service of the city of Lackawanna, with the exception of those hereinafter enumerated in the unclassified service.

Appointment of Commissioners - Rule II

1. For the purpose of ascertaining the merit and fitness of persons seeking or named for the positions in the departments of the municipal government to which these rules apply, there shall be a Municipal Service Commission, which shall be composed of three citizens of the city of Lackawanna designated and appointed by the Mayor, each of whom shall be known as a Municipal Civil Service Commissioner of the city of Lackawanna and not more

than two of which shall belong to the same political party. The said Commissioners shall serve without compensation. The Mayor may, at any time, by filing with the City Clerk a written notification of the change, appoint another citizen in the place of any one so designated. Said Commission shall designate one of its own members as president. The Mayor shall appoint a secretary who shall act under the direction of said Commission and whose salary shall be fixed by the Mayor. It shall be the duty of such Municipal Civil Service Commission to conduct all examinations called for under these rules, to ascertain the merit and fitness of candidates for admission into the civil service of the city in respect to character, knowledge and ability for the particular branch of the service into which they seek to enter, and to estimate and determine the relative excellence or standing of the persons examined, and to certify the same in such manner and form as may be prescribed. They shall also make and file with the State Civil Service Commission such annual and other reports and roster of the classified civil service of said city as required by chapter 15 of the Laws of 1909. The secretary of the Commission shall keep the minutes of its proceedings and all necessary records of applicants, their examinations and standings, and a complete record of all persons employed in the several departments and offices to which these rules apply, and all appointments, promotions, transfers, dismissals, resignations and changes of any sort therein.

2. It shall be the duty of the Common Council of the city of Lackawanna to cause suitable rooms and accommodations to be provided for carrying on the work and examinations of the Municipal Commission as its ends shall require and said Commission shall order the necessary appurtenances, stationery, postage stamps, official seal and record books and other articles to be supplied, and the necessary printing, typewriting, etc., to be done for its official use, the reasonable expense of which, and the necessary disbursements of the Municipal Commission, shall be audited, and paid by the city of Lackawanna.

The civil service of the city of Lackawanna is divided into the unclassified service and the classified service.

First. The unclassified service includes:

1. All officers elected by the people.

2. The head or heads of any department or office of the city government.

3. Persons employed in or who seek to enter the public service as superintendents, principals, or teachers in the educational department of the city.

4. All election officers.

Second. The classified service includes all positions not in the unclassified service. The positions in the classified service are hereby classified in four classes, to be known as the exempt class, the noncompetitive class, the competitive class and the labor class, as enumerated in respective schedules hereunto attached and hereby made a part of these rules.

The Exempt Class Rule IV

The exempt class shall include:

First. One secretary of each officer, board or commission authorized by law to appoint a secretary.

Second. One clerk, and one deputy clerk if authorized by law of each court.

Third. Other subordinate offices for the filling of which competitive or noncompetitive examination may be found to be not practicable. But no office or position shall be deemed to be in the exempt class unless it is specifically named in schedule of exempt class here to annexed. Not more than one appointment shall be made to or under the title of any such office or position, unless a different number is specifically mentioned in such schedule.

The appointments to positions comprised in the Exempt Class may be made without examination under these rules. Appointing officers must notify the Municipal Civil Service Commission
