FISH, GAME AND FOREST LAWS OF NEW YORK.

The laws for the protection, preservation and propagation of birds, fish and wild animals in the State were codified and re-enacted by the Legislature in 1892, amended in 1893 and 1894, revised and re-enacted and consolidated with the forest laws in 1895, and further amended in the succeeding years. They constitute chap. 31 of general laws. They are also known as chap. 48 of the laws of 1892, as amended by the Legislature each year since.

A law makes catching and killing beaver a misdemeanor punishable by a fine of $50.

An important law says that any person owning land which he reserves as private fishing-premises if "hereafter stocked by the State from any of the hatcheries, hatching stations, or by fish furnishers at expense of the State, shall remain open the public to fish therein.

Another law states that "No trout of any kind, salmon trout or land locked salmon shall be taken away from waters of this State to stock a private bond or stream, except that the owner may, upon the written consent of the fisheries, game and forest commission, take such fish from stream of water running through premises owned by him, for the purpose of being placed in such private pond."

The law in its application to fresh water also provides for the licensing of nets. If nets are licensed and have a tag on the protectors and foresters can identify owner of net illegally used. and if the tag is missing the net can be destroyed. The law prohibits the polluting of streams or taking fish by drawing off water or by dynamite, or from a stream to stock a private pond or stream. No fishing through the ice in waters inhabited by trout or salmon.

Game.

(Game must not be transported out of the State.) Deer-Close season Nov. 16 to Aug. 31, both inclusive. Fawns in spotted coat shall not be taken or possessed at any time. Dogs cannot be used in hunting, and may be killed if found in the deer forest. Not more than two deer may be taken. Venison shall not be possessed or sold from Nov. 21 to Aug. 31, both inclusive. Possession of venison from Nov. 16 to Nov. 2), is presumptive evidence that it was unlawfully taken. Only one carcass can be transported and must be accompanied by owner; and not more than two carcasses can be thus transported in one year, but this does not apply to the head, feet or skin of deer carried separately. Traps, salt licks and other devices, also crusting and yarding are illegal. Jacking is prohibited. There is no open season until Sept. 1. 1907, in Delaware, Greene, Oswego, Putnam, Rensselaer and Ulster Counties, nor in that part of Jefferson, Lewis and Oneida west of the Utica and Black River Railroad, from Utica to Ogdensburg. Close season in Orange and Sullivan Counties, Nov. 16 to Oct. 31. both inclusive. On Long Island deer may be taken on the first two Wednesdays and Fridays after the first Tuesday of Nov. Dogs may be used there on those days only. Possession of venison in the forests of Suffolk County on other days is presumptive evidence of violation of the law. Deer which have escaped from private premises may be retaken by owner.

Hares and Rabbits-Close season in the Countles of Albany, Columbia, Jefferson, Livingston, Monroe, Orleans, Steuben. Wyoming, Dec. 16 to Sept. 15, both inclusive; in Rockland Co., from Dec. 31 to Oct. 31, both inclusive; in Dutchess. Herkimer, Oneida and Sullivan Counties, Feb. 15 to Sept. 15. both inclusive; in Greene, Schenectady and Ulster Counties, Dec. 16 to Sept. 30, both inclusive: in Fulton Co., from Feb. 1 to Oct. 31, both inclusive; in Erie Co., Jan. 16 to Sept. 30, both inclusive; in Orange Co., Dec. 16 to Oct. 15, both inclusive; in Rockland Co., Dec. 31 to Oct. 31, both inclusive; in Richmond Co.. Dec. 16 to Oct. 31, both inclusive. (No hunting while snow is on the ground.) Ferrets must not be used in Cattaraugus Co. before Jan. 1. 1905. nor at any time in counties where there is a close season. nor in Genesee, Niagara and Schoharie Counties. Farmers may clear their lands of hares and rabbits if injurious.

Squirrels.-Close season for black and gray squirrels Dec. 1 to Sept. 15, both inclusive; in Greene

Co., from Dec. 16 to Sept. 30, both inclusive; in
Rensselaer Co., Dec. 1 to Sept. 30, both inclusive;
in Orange Co., Dec. 16 to Oct. 15, both inclusive.
No open season in Richmond Co.; on Long Island,
Jan. 1 to Oct. 31. both inclusive.

Birds.

Partridge (Grouse).-Close season Dec. 1 to Sept. 15, both inclusive; in Greene, Ulster and Sullivan Counties, Dec. 1 to Sept. 30, both inclusive; in Orange Co., Dec. 1 to Oct. 15, both inclusive; on Long Island, Jan. 1 to Oct. 31, both inclusive. No open season in Westchester Co. prior to 1905. Not more than 36 may be taken by one person in a season. Must not be possessed during close season, and must not be sold or offered for sale except by bonded dealers. Must not be transported out of State, nor in State, except accompanied by actual owner.

Pheasants.-No open season (except in Suffolk Co.) before 1905. In Suffolk Co., they must not be taken or possessed between Jan. 1 and Oct. 31, both inclusive.

Plover.-Close season May 1 to Aug. inclusive; on Long Island, Jan. 1 to both inclusive.

Quail-Close season Dec. 1 to Oct. 31. season before 1906 in Schoharie Co., nor before 1908 in Richmond Co. Must not be possessed in close season, except in Dec. and, if possessed in Dec., it is presumptive evidence they were unlawfully taken. Must not be taken or offered for sale in the Counties of Delaware, Greene, Schoharie, Sullivan and Ulster. On Long Island quail must not be taken from Jan. 1 to Oct. 31, both inclusive; on Gardiner's Island quail may be taken from Oct. 15 to Jan. 31, both inclusive,

Robins (and other wild birds)-No open season. Snipe-Close season May 1 to Aug. 31, both inclusive; on Long Island Jan. 1 to June 30, both inclusive.

Wild fowl-Close season for brant, ducks, geese and swan, Jan. 1 to Sept. 15, both inclusive. Must not be possessed from March 1 to Sept. 15, both inclusive, nor hunted between one hour after sunset and one hour before sunrise; must only be shot with gun fired without rest. In Jefferson Co. must not be taken from Jan. 1 to Sept. 15, both inclusive, or in the night from one-half hour after sunset until daylight. The use of boats (except propelled by hand) and of floating devices is illegal more than 50 feet from shore. On Long Island the close season is for ducks, geese and swan, Jan. 1 to Sept. 30. both inclusive; must not be possessed from March 1 to Sept. 30, both inclusive; no hunting can be done between sunset and daylight. Brant must not be taken or possessed from May 1 to Sept. 30, both inclusive, nor hunted between sunset and daylight. Any floating device may be used at any distance from the shore in Long Island Sound and Shinnecock, Gardiner's and Peconic Bays, and except from Sept. 30 to Oct. 19. both inclusive. in Great South Bay west of Smith's Point. Sailboats are lawful in Long Island Sound, Gardiner's and Peconic Bays.

Woodcock-Close season Dec. 1 to Sept. 15, both inclusive. Not more than 36 may be taken in one season. Must not be sold or offered for sale in this State, nor carried out of the State, nor transported in the State unless accompanied by the actual owner. Close season in Rensselaer Co., Dec. 1 to Sept. 30, both inclusive: in Orange Co., Dec. 1 to Oct. 15. both inclusive; on Gardiner's and Robins Islands, Aug. 1 to Dec. 31, both inclusive: on Long Island, Jan. 1 to July 31, both inclusive.

Fish.

Bass (black)-Close season Jan. 1 to June 15, both inclusive. Cannot be legally taken less than 10 inches long. Not more than 24 to be taken in one day and not more than 36 by two persons in one boat. Close season for Chautauqua Lake, Oct. 16 to June 15, both inclusive; for Cassadaga and Bear Lakes, Dec. 1 to June 15, both inclusive; in St. Lawrence River and in Jefferson Co., Jan. 1 to June 9: in Lake George and Schroon Lake. Dec. 16 to July 31; in Salmon River (in town of Fort Covington, between Canada line and dam in village) and in St. Regis River (in Town of Bombay between Canada line and Mills and Lantry dam), Nov. 15 to May 1. In Orange Lake, no fishing between one hour after sunset and one

(But may be bought and sold by licensed Close season dealers if taken without the State). in Lake George or Glen Lake, Jan. 1 to June 15, both inclusive; in St. Lawrence River, Jan. 1 to Pickerel may be taken June 9, both inclusive. through the ice or with tip-ups, except during March and April, in Lake Keuka or Crooked Lake, Queechy Lake or Sullivan and Greene Co. waters (not inhabited by trout), in Lake Neatahwanta, in Owasco Lake (from its head to a line running from the ravine south of Pulver cottage to ravine north of Foster cottage); in Canandaigua Lake from a line running from the edge of swamp on west shore at head of lake northerly along west shore to Hazel Dell Cabin, thence southerly across to buttonwood tree north of large landslide, and about 40 rods north of Sunnyside dock, west shore to edge of thence southerly along swamp, thence westerly to beginning; and in Honeoye Lake, Canadice Lake and Conesus Lake, except in March and April, and by set lines in Susquehanna River, and the Chenango and Unadilla Rivers and tributaries in Chenango Co. and in the Tioughnioga and Otselic Rivers in Broome Co. during the same time.

Forest Law.

All the wild or forest land now owned or hereafter acquired in the counties of St. Lawrence, Franklin, Clinton, Essex, Warren, Washington, ter, Sullivan and Delaware, Fulton and Saratoga, Hamilton, Herkimer, Oneida, Lewis, Greene, Ulsconstitute the Forest Preserve, and cannot be sold or leased nor the timber disposed of.

The Adirondack Park includes all lands now owned or hereafter acquired by the State within the county of Hamilton; towns of Newcomb, MInerva, Schroon, North Hudson, Keene, North Elba, St. Armand and Wilmington, in Essex County; the towns of Harrietstown, Santa Clara, Altamont, Waverly and Brighton, in Franklin County; the towns of Webb and Wilmurt, in Herkimer County; the towns of Hopkinton, Colton, Clifton and Fine, in St. Lawrence County; the towns of Johnsburgh, Stony Creek and Thurman, and the islands in Lake George, in Warren County. park shall forever he reserved and maintained for the free use of all the people.
